<br />need for a 40 foot wide easement for the sanitary sewer interceptor and City <br />underground utilities. If vacated, the right-of-way would revert back to the adjacent <br />property owners on the north and south of the lona Lane right-of-way. To the north is <br />the Ryan Company site, presently being developed. On the south is the Old Dominion <br />trucking terminal site. Ryan Company's portion of the vacated right-of-way could be <br />used for temporary or permanent storm water ponding. There are no plans for <br />immediate use of the property by Old Dominion. <br /> <br />The City Council conducted a public hearing on October 14, 1996, There were no <br />objections to the proposed vacation expressed at this hearing. The Council continued <br />this matter until October 28, 1996. <br /> <br />Staff Recommendation: <br /> <br />If the Comprehensive Plan is changed and the right-of-way is no longer needed for <br />Twin Lakes Parkway, the proposed right-of-way would not be needed for public <br />purposes. Therefore, staff recommends approval of a resolution to vacate the right-of- <br />way, subject to retention of a 40 foot easement for utility purposes. However, final <br />actio'n on this vacation should be continued to the first meeting in February, 1997, to <br />allow the preliminary feasibility reports to be completed on Twin Lakes Parkway <br />alignment. <br /> <br />Planning Commission Recommendations: <br /> <br />The Planning Commission, at the October 9, 1996 meeting, unanimously recommended <br />that the City Council approve the vacation of the portion of the unimproved, dedicated <br />and City owned right-of-way of lona Lane lying east of Cleveland, west of Hyman <br />Freightways, north of the Old Dominion truck terminal site, and south of the former <br />Midwest Motor Express site subject to maintenance of a 40 foot utility and drainage <br />easement and subject to approval of a Comprehensive Plan amendment to realign <br />Twin Lakes Parkway. <br /> <br />Suggested Council Action: <br /> <br />~ <br /> <br />1. Accept additional comment close the hearing. <br /> <br />2.
