need for a 40 foot wide easement for the sanitary sewer interceptor and City
underground utilities. If vacated, the right-of-way would revert back to the adjacent
property owners on the north and south of the lona Lane right-of-way. To the north is
the Ryan Company site, presently being developed. On the south is the Old Dominion
trucking terminal site. Ryan Company's portion of the vacated right-of-way could be
used for temporary or permanent storm water ponding. There are no plans for
immediate use of the property by Old Dominion.

The City Council conducted a public hearing on October 14,1996. There were no
objections to the proposed vacation expressed at this hearing. The Council continued
this matter until October 28, 1996.

Staff Recommendation:

If the Comprehensive Plan is changed and the right-of-way is no longer needed for
Twin Lakes Parkway, the proposed right-of-way would not be needed for public
purposes. Therefore, staff recommends approval of a resolution to vacate the right-of-
way, subject to retention of a 40 foot easement for utility purposes. However, final
action on this vacation should be continued to the first meeting in February, 1997, to
allow the preliminary feasibility reports to be completed on Twin Lakes Parkway
alignment.

Planning Commission Recommendations:

The Planning Commission, at the October 9, 1996 meeting, unanimously recommended
that the City Council approve the vacation of the portion of the unimproved, dedicated
and City owned right-of-way of lona Lane lying east of Cleveland, west of Hyman
Freightways, north of the Old Dominion truck terminal site, and south of the former
Midwest Motor Express site subject to maintenance of a 40 foot utility and drainage
easement and subject to approval of a Comprehensive Plan amendment to realign
Twin Lakes Parkway.

Suggested Council Action:

1. Accept additional comment close the hearing.

2. By motion, continue the final action on the vacation to the first meeting in
February, 1997, to allow the preliminary feasibility reports to be completed on
Twin Lakes Parkway alignment.

Attachments:

1)
2)

Maps
Planning Commission Minutes

Staff Report by: Rick Jopke, Assistant Community Development Director (490-2241).

2
