Iona Lane was <br />initially platted many years ago as a 40 foot street right of way. <br />Subsequent to the platting of Iona Lane, the properties on the <br />North and South of Iona Lane each conveyed an additional 10 feet by <br />quit claim deed. Quit claim deeds were signed by E. H. Willmus <br />Properties on April 29, 1959. The quit claim deed stated: <br /> <br />" <br /> <br />for public roadway and highway purposes." <br /> <br />t <br /> <br />You ask the following question. <br /> <br />Q. IN VIEW OF THE ABOVE, WHAT IS THE PROPER PROCEDURE TO <br />VACATE IONA LANE TOGETHER WITH THE TWO STRIPS OF LAND 10 FT. <br />IN WIDTH LYING TO THE NORTH AND SOUTH OF THE 40 FT. RIGHT OF <br />WAY? <br /> <br />IN OUR OPINION, THE USUAL PROCEDURE SHOULD BE FOLLOWED. <br /> <br />This procedure is set forth in Minn. Stat. ~412.851. Enclosed is <br />a copy of that statute. Please note that in the event any public <br />right -of -way terminates at or abuts upon any public water the <br />Commissioner of Natural Resources must receive notice of the <br />hearing. <br /> <br />* Also Admitted in Wisconsin <br />tCivil Trial Specialist.
