Mr. Seaberg has not mentioned the billboard in <br />his application narrative. Advertising signs of this type are <br />not allowed in any zoning district in the city, and we are <br />requesting that an agreement to remove the billboard be part of <br />the interim use application. <br /> <br />2. DEVELOPMENT ANALYSIS <br /> <br />There are three separate but related requests in this application: <br />rezoning, division of lot, and interim use permit. Each is <br />discussed separately below. <br /> <br />Rezoninq <br /> <br />The lot in question is currently zoned R-1, Single Family <br />Residence, and the request is to rezone it to R-2, Two Family <br />Residence. The adjacent land uses on the three abutting lots to <br />the north are business, duplex, and single family. The adj acent <br />land use to the south is an existing duplex on a similar through <br />lot. The land uses on the lot in question are single family and an <br />unoccupied duplex, built in accordance with the transitional use <br />section noted above. The lot meets the minimum standards for the <br />R-2 District and even if split, as requested, the new lots could <br />still meet the minimum lot size standards. <br /> <br />Permitted uses in the R-2 District' include duplexes and single <br />family homes. Billboards (defined as "advertising signs" in the <br />Code) are not a permitted use. Such signs are defined in section <br />14.020 and prohibited in section 14.030. The billboard on this <br />lot has been there since the 1950s. But with a rezoning request, <br />the city has the right to require that the uses on the property <br />be brought into conformance with the Code. <br /> <br />Considering the existing land uses on the lot and on the <br />surrounding p~operties, and the size and configuration of the lot, <br />the rezoning request is reasonable if the billboard is removed. <br /> <br />Division of Lot <br /> <br />The lot in question is illustrated on the attached survey and <br />noted on the applicant's narrative as 100' x 436', exactly one <br />acre in size. However, when street rights-of-way are subtracted <br />(30' for Wheeler, 43' for Fairview) the lot is 100' x 363', or <br />36,300 square feet (0.83 acre, not 0.93 acre as noted). The <br />minimum lot requirements are the same for the R-1 and R-2 <br />Districts: 85' wide, 110' deep, and 11,000 square feet in area. <br />The lot is of sufficient size to create two lots that meet all <br />Code standards, and the lot split could be appropriate for either <br />the existing R-1 zoning or the requested R-2 zoning. <br />
