<br />City of Roseville <br />Community Development Department <br /> <br />Memo <br />Ian, 26, 1996 <br /> <br />TO: Steve Sarkozy, City Manager <br /> <br />FROM: Dennis Welsch, Community Development Director (490-2232) <br /> <br />RE: EAGLE CREST EASEMENTS ALONG COUNTY DITCH 4 <br /> <br />Today I spoke with Paul Sentman (628-3005) regarding the solutions to the adjoining neighbors <br />concerns about the height and landscaping of the Eagle Crest project. Sentman said they are now <br />into serious negotiations over how to solve the neighbors concerns, He said the neighbors feel the <br />west side of the County Ditch 4 ravine (from the center line of the creek) is their property and <br />some currently use it for landscaping, when in reality, Eagle Crest owns a strip whi~h begins at <br />the neighbors back ( east) property lines less than 1 foot wide on the north, but approximately 30 <br />feet wide on the south edge of the property line, <br /> <br />He asked if he could simply give them this property, to the middle of the creek, as one means of <br />settling some of the disputes, He asked if this (reduction in land area) would change the density <br />calculations for the Eagle Crest future phases, I told him that this density issue was not a <br />major concern with staff (because the area is unbuildable anyway - within 50 feet of a <br />creek), and would not change the density of the project as we review it. And, as an <br />alternative, if he was concerned about "picky neighbors or staff reviews", he may want to <br />think of a way to transfer access easements and a landscape easement to the neighbors, <br />while retaining the underlying title. <br /> <br />Mr. Sentman will evaluate the differences between retaining ownership and granting easements, <br />versus outright gift of the land and reduced college liability for some accident on these steep <br />slopes, His immediate thought was that on outright gift was simpler and benefitted all properties <br />more than easements, ' <br /> <br /> <br />xc' t~e North, Chuck Stifter, Mike Falk <br />c: Col e Properties file <br /> <br />1 <br />
