REQUEST FOR COUNCIL ACTION <br /> Date: 11/10/2014 <br /> Item No.: 11.a <br />Department Approval City Manager Approval <br />Item Description: Public Hearing to Consider Approving the 2015 Liquor License Renewals <br />B <br />ACKGROUND <br />1 <br />Under City Code, a public hearing is required to consider approving liquor license renewals for the <br />2 <br />following calendar year. The City has received the following renewal applications for 2015: <br />3 <br />4 <br />10 Off Sale Intoxicating liquor licenses (maximum of 10 permitted under City Code) <br />5 <br />24 On Sale Intoxicating liquor licenses <br />6 <br />17 On Sale 3.2 Non-Intoxicating Malt Liquor licenses <br />7 <br />9 Off Sale 3.2 Non-Intoxicating Malt Liquor licenses <br />8 <br />4 Club liquor licenses <br />9 <br />13 Wine only liquor licenses <br />10 <br />2 Brewery Taproom Off Sale License <br />11 <br />1 On Sale and Sunday Brewer’s Taproom license <br />12 <br />13 <br />A detailed list of all liquor license renewals is included in Attachment A. <br />14 <br />15 <br />The following liquor establishments had liquor compliance failures during 2014: <br />16 <br />17 <br />Presumptive Penalty <br />DateEstablishmentImposed <br />5/1/2014 Smashburger $2,000 fine, 5 day suspension <br />5/1/2014 Romano’s Macaroni Grill $1,000 fine, 1 day suspension <br />8/13/2014 Joe Senser’s Bar & Grill $1,000 fine, 1 day suspension <br />8/13/2014 Cub Foods (2100 Snelling) $1,000 fine, 0 day suspension <br />8/13/2014 Super America #4115 $1,000 fine, 0 day suspension <br />(2785 Hamline) <br />18 <br />The Council has discretion to factor in these compliance failures in considering whether to renew a liquor <br />19 <br />license. <br />20 <br />21 <br />A letter addressed to the Council from a Smashburger representative regarding its liquor compliance failure <br />22 <br />is included in Attachment B. <br />23 <br />Page 1 of 5 <br />
