Johnson on-site to review
the required drainage. At that tillie, we suqqested tbat a
catch basin be installed on top of a stora sewer pipe wbich
exists on the north side of the Suburban Bard-Jare property.
In addition, we reiterated the need for concrete curb and
gutter and the additional setback on the west side. Shortly
therea.fte!:, :r prepared a sche1latic drawing outlinlnq
potential drainage SOlO1ticns and delivered it to Gordie, who
in turn gave it to Hr. JOhnson.

3. Aa1JUSt 7

Mr. ~ohr.son met with Steve Catlin and ae to discuss the cost
of +-J1e city's r&qtlired iJBproveJl1ents. Hr. Johnson bad SODe-
roug.. figures which were much higher than we would estimate.
We suqqested t1&at be contact some other contractors 'to qet
more reasonable prices and provided him with a list of
~ors licensed in the city. Mr. Johnson indicated at
th~s tiBle that he thought the city's requireaents were
unreasonable.

4. Jlic'1 August

After DOAch discussion. Steve Gatlin rescinded the
rec:;uireaent for on-site drainage allowing SUburban Hardware
to drain their run-off into LexiD9 '...n Avenue. However, bR
specifically told J.:r. Johnson that concrete curb and the new
wes~ setback were still requi=ements for permit approval.

5. Lat.e AUCJUst

We discovered that Sw>urban Hacdware has re-paved their
parking lot. They did not install the required concrete
curb, set the west side back the appropriata distance, or
obtain the required city building permit.

Based on the above facts and discussions with Steve Gatlin. I
consulted Steve ~arkc~y L~qdcainq this issue. He suqqested thQt
we take action as necessary to bring this lot into compliapce.
The~ is no question that Hr. Johnson fully understood the city's
requirements and chose to ignore them. Please contact me if you
need additional information.

cc: Steven D.
