This covers about 108 acres or 600.10 of the Twin Lakes Redevelopment Area. <br /> <br />These Ryan Companies first offer to develop rights automatically continue on to <br />November 24, 2008 UNLESS the city notifies RYAN COMPANIES, pursuant to the <br />agreement, in writing, 60 days prior to November 24, 2003 that it is terminating this first <br />offer right. <br /> <br />I see no reason to continue Ryan's preferential treatment, and many disadvantages <br />to developing this area. In order to place all developers on an equal plane, I recommend <br />that the council instruct city staff to prepare the appropriate letter to notify Ryan in <br />writing that the City is terminating it's rights offirst offer as of November 24, 2003, on <br />or before September 1, 2003. <br /> <br />Perhaps staff can tell the council what advantages or disadvantages it sees. Ryan <br />has not done any significant development under this agreement for years. It has been <br />busy on its agreement to develop TIF 1 area, and has ignored the Twin Lakes <br />Development Area. <br /> <br />SUGGESTED MOTION: <br /> <br />I move to instruct city staff to prepare the necessary document(s) so as to <br />~rminate Ryan's right offirst offer under it's current agreement with the City so as to <br />conform to the requirements under the agreement, and to have that done by September 1, <br />2003. <br /> <br />Please do not let this matter slide into inaction, and a continuation of Ryan's <br />preferential treatment for another five years.
