This covers about 108 acres or 600.10 of the Twin Lakes Redevelopment Area. These Ryan Companies first offer to develop rights automatically continue on to November 24, 2008 UNLESS the city notifies RYAN COMPANIES, pursuant to the agreement, in writing, 60 days prior to November 24, 2003 that it is terminating this first offer right. I see no reason to continue Ryan's preferential treatment, and many disadvantages to developing this area. In order to place all developers on an equal plane, I recommend that the council instruct city staff to prepare the appropriate letter to notify Ryan in writing that the City is terminating it's rights offirst offer as of November 24, 2003, on or before September 1, 2003. Perhaps staff can tell the council what advantages or disadvantages it sees. Ryan has not done any significant development under this agreement for years. It has been busy on its agreement to develop TIF 1 area, and has ignored the Twin Lakes Development Area. SUGGESTED MOTION: I move to instruct city staff to prepare the necessary document(s) so as to ~rminate Ryan's right offirst offer under it's current agreement with the City so as to conform to the requirements under the agreement, and to have that done by September 1, 2003. Please do not let this matter slide into inaction, and a continuation of Ryan's preferential treatment for another five years. Thank you. AL SANDS
