<br />EXTRACT OF MINUTES OF MEETING OF THE <br />CITY COUNCIL OF THE CITY OF ROSEVILLE <br /> <br />Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br />Roseville, County of Ramsey, Minnesota, was held on the 13th day of May 2002, at 5:30 p.m. <br /> <br />The following members were present: Schroeder, Maschka, Klausing, Kough, Kysylyczyn <br />and the following were absent: None <br /> <br />Council Member Schroeder introduced the following resolution and moved its adoption: <br /> <br />RESOLUTION NO. 9995 <br />A RESOLUTION APPROVING A 14 FOOT VARIANCE TO SECTION 1009.03M OF <br />THE ROSEVILLE CITY CODE FOR BRENTWOOD TOWN OFFICES (PF3391) <br /> <br />WHEREAS, Brentwood Town Offices, 23322 to 2340 Lexington Avenue, has requested <br />a variance to Section 1009.03M of the Roseville City Code to install a ground mounted sign one <br />foot from the west property line; and <br /> <br />WHEREAS, Brentwood Town Offices is legally described as: <br /> <br />WHEREAS, Section 1009.03M states that a ground mounted sign must be set back a <br />minimum of 15 feet from a property line; and <br /> <br />WHEREAS, "Undue hardship" as used in connection with the granting a variance means <br />the property in question cannot be put to a reasonable use ifused under conditions allowed by <br />the official controls, the plight of the land owner is due to circumstances unique to the property <br />not created by the land owner, and the variance, if granted, will not alter the essential character <br />of the locality; and <br /> <br />WHEREAS, specifically to this request the Planning Commission determined: <br /> <br />A The property in question cannot be put to a reasonable use if used under <br />conditions allowed by the official controls: The Roseville Planning Commission <br />determined that the property cannot be put to reasonable use under the official <br />controls. Brentwood Town Offices should be allowed visible signage. Facade <br />signage would be more difficult to see than a ground sign. The existing trees <br />block a clear view of a facade or monument sign at the required setback. <br />Additionally, the site's grade at the optimal sign location slopes east toward the <br />parking lot adding to the visibility problems. Another factor staff has considered <br />is the amount of boulevard along Lexington Avenue. Currently, the east side of <br />Lexington A venue has a boulevard from curb to property line of approximately 33 <br />feet. <br /> <br />Page 1 of2 <br />
