<br />REQUEST FOR CITY COUNCIL ACTION <br /> <br /> <br />DATE: 04/22/02 <br />ITEM NO: Reg;lllar Meeting II. <br />Agenda Section: <br />LAND USE <br /> <br />A request by Bradley Hoff, 1897 Shady Beach Avenue, for a Variance to <br />Section 1012.02B2 of the Roseville City Code (PF3347) <br /> <br /> <br />On November 26, 2001 the City Council continued this case pending the outcome of a <br />mediation process. The mediation process is now complete and the recommendations include <br />variances for fences along the streets side of Mr. Hofrs lot, provided the fences along the lake <br />side be reduced. (See the attached memo from the mediation sessions. Based on the mediation, <br />the Council is now asked to decide on the variance and the cost of fence relocation. What <br />follows is the text of the original variance request and recommendations. A letter (attached) <br />notifying neighbors ofthis agenda item was sent out on Tuesday, April 16 (or earlier) and was <br />received on April 17, 2002. <br /> <br />1.0 INITIALLY REQUESTED ACTION <br /> <br />1.1 Mr. Hoff has requested a 2-1/2 foot variance to Section 1012.02B2 (Certain Structures <br />Not Considered Encroachments) to allow a recently installed fence to be 6-1/2 feet tall in <br />a front yard. <br /> <br />SECTION 1012.02B2 <br />Code Requirement Existing Condition Variance Requested <br />4 foot height in front yard 6-112 foot height in front yard 2-112 feet <br /> <br />PROJECT REVIEW HISTORY <br />. City Council review/action - 11/26/01. <br /> <br />2.0 BACKGROUND <br /> <br />2.1 On August 13, 1990 Mr. Hoffreceived a minor variance to allow construction of a <br />detached garage five feet from the front property line. The minor variance process (no <br />longer used by the City) required the signatures of adjacent property owners supporting <br />the variance being requested. Mr. Hoff did receive the necessary signatures and City <br />support for the 25-foot front yard setback encroachment. The minor variance site plan <br />(attached) included the other improvements that would occur on the property, including <br />the installation of a retaining wall and installation of a fence.
