As I explained to <br />you, the shoreland ordinances statewide are silent on calling fences structures due to the fact that <br />people want to protect small children and confine livestock in the outs tate areas. Communities can <br />be more restrictive and often have fence standards in their local codes. The state building code also <br />offers some standards on when fences require permits. In this case the white plastic fence does not <br />seem to be safety related, so I would think that the owner would have difficulty showing hardship <br />for the issuance of a variance to the city's standards. <br /> <br />Some communities do try to regulate structures that cause aesthetic concerns on lakes. Clearly, if <br />one drives around the lake, there are no other such structures, and it does represent a visual intrusion <br />from my point of view. However, the shoreland regulations do not have any authority to regulate <br />such things unless the local government wishes to amend their shoreland ordinance. I have included <br />some pages from the city of Shore view's ordinance.
