October 2, 2001

Roseville Community Development Department
Attn: Thomas Paschke - City Planner
2660 Civic Center Drive
Roseville, MN 55113

RE: Variance Application (City Code Section 1013)
Property Address: 1897 Shady Beach Avenue, Roseville, MN 55113

Dear Mr. Paschke,

Let it be known that we are filing thi& Variance Application with the City ofRoseville
under protest. The reason for the protest is that we were issued a signed and approved
building permit on April27, 2001, to replace our existing fence, which had been built in
1991. The site plan submitted in 1991 was signed by all of the surrounding neighbors in
favor of the variance request. Also having gone through approvals from both the
Lakeshore Committee and Roseville City Counsel, a variance and building permit were
issued to us in 1991 to build a garage, retaining walls, concrete driveway, sidewalk, and
cedar privacy fences (which were approved for over 48" in height).

The permit issued us on April 27, 2001, to replace the existing; cedar fence (which was
approximately 5' 1 A" tall) allowed a maximum fence height of6'6" for the entire length
of fencing (including the front yard section). We contracted Awe-Fence Company to
build our pre-paid, custom-made vinyl fence at their factory, and to schedule the
installation as soon as possible. Thi&fence was installed per the requirements of the
issued permit between July 10 and July 16, 2001.

On August 14,2001, we received a letter from you stating that we had installed a
non-conforming fence, which contradicts the building permit your department issued us.
In following your suggestion to apply for a variance, the hardships are as follows:

. Our bathroom window and bedroom windows are facing the front yard of the house,
which doesn't give us privacy from neighbors and cars looking into the windows of
our house.
. A taller fence blocks views and headlights from neighbor's driveways.
. A taller fence blocks headlights from night-time traffic due to the slope of the
adjacent roads and driveways.

Thank you for your time in reviewing this matter.

Sincerely,

!2~a ..~
;.-1 ..~'.'-.)
l~ . .'.

Brad and &mUe &ff
