3.0 MINOR VARIANCE COMMITTEE 3.1 The request for the variance included the required application form, sketch of the property and proposed driveway, written statement from the applicant, and written approval from the adjacent property owner affected by the variance (Daniel Carver at 404 Minnesota Avenue). 3.2 The Minor Variance Committee reviewed this request on October 21,1997, and unanimously recommended approval of a minor variance to reduce the side yard setback of a driveway to one foot for the purpose of expanding an existing driveway at 398 Minnesota Avenue, based on the following findings: 1. The substandard width and topography of the lot creates a practical difficulty for the applicant. 2. Maintaining a driveway setback of at least one foot will facilitate drainage of the lot and prevent water from being diverted onto the adjacent property. 3. The width of the driveway will not exceed 26 feet at the property line. 4. The proposed variance is in harmony with the general purpose and intent of the City's Comprehensive Plan and Title 10 of the City Code (Zoning). 5. The variance, if granted, will not adversely affect the public health, safety, or general welfare. 4.0 SUGGESTEDACnON 4.1 By motion, approve Rick Rogowski's request for a minor variance to reduce the side yard setback of a driveway to one foot for the purpose of expanding an existing driveway at 398 Minnesota Avenue, based on the findings of the Minor Variance Committee outlined in section 3.2 of this report.
