<br />3.0 MINOR VARIANCE COMMITTEE <br /> <br />3.1 The request for the variance included the required application form, sketch of the <br />property and proposed driveway, written statement from the applicant, and written <br />approval from the adjacent property owner affected by the variance (Daniel Carver <br />at 404 Minnesota Avenue). <br /> <br />3.2 The Minor Variance Committee reviewed this request on October 21,1997, and <br />unanimously recommended approval of a minor variance to reduce the side yard <br />setback of a driveway to one foot for the purpose of expanding an existing driveway <br />at 398 Minnesota Avenue, based on the following findings: <br /> <br />1. The substandard width and topography of the lot creates a practical difficulty <br />for the applicant. <br /> <br />2. Maintaining a driveway setback of at least one foot will facilitate drainage of <br />the lot and prevent water from being diverted onto the adjacent property. <br /> <br />3. The width of the driveway will not exceed 26 feet at the property line. <br /> <br />4. The proposed variance is in harmony with the general purpose and intent of <br />the City's Comprehensive Plan and Title 10 of the City Code (Zoning). <br /> <br />5. The variance, if granted, will not adversely affect the public health, safety, or <br />general welfare. <br /> <br />4.0 SUGGESTEDACnON <br /> <br />4.1 By motion, approve Rick Rogowski's request for a minor variance to reduce the side <br />yard setback of a driveway to one foot for the purpose of expanding an existing <br />driveway at 398 Minnesota Avenue, based on the findings of the Minor Variance <br />Committee outlined in section 3.2 of this report. <br /> <br />Attachments: Property location map; minor variance application; written statement from applicant; written <br />consent from adjacent property owners; sketch of property; photographs of property. <br /> <br />60-day Time Limit: Application accepted on October 13, 1997; Decision deadline is December 12, 1997. <br /> <br />Prepared by: Kim L.
