The plight of the landowner is due to circumstances unique to the property not <br />created by the landowner: The property is a comer lot that is given limited <br />development options within the front yard. In the case of the Freeman parcel, the <br />front yard is Huron Street; however, the principal structure, detached accessory <br />building, and the properties address result in a perceived front yard of Wood hill <br />Drive. The uniqueness of this property and the limited flexibility of the City <br />Code to deal with situations similar to that of the Freeman's have contributed to <br />the need for a variance <br /> <br />C. The variance, if granted, will not alter the essential character of the locality: <br />The proposed height variance will not alter the essential character of the locality, <br />nor adversely affect the public health, safety, or general welfare, of the city or <br />adjacent properties. <br /> <br />5.0 STAFF RECOMMENDATION <br /> <br />Based on the comments and findings outlined in Section 3 and 4 of this report, staff <br />recommends approval of the request for a two foot height variance to Section 1012.02B2 of <br />the City Code, to allow the construction of a six foot tall fence in a portion of the front yard of <br />property located at 1296 Woodhill Drive. <br /> <br />6.0 SUGGESTED PLANNING COMMISSION ACTION <br /> <br />By motion recommend approval (approval w/modifications or deny) the request by Clinton <br />Freeman for a two-foot height variance to Section 1012.02B2 of the City Code, to allow the <br />construction of a six foot tall fence in a portion of the front yard of property located at 1296 <br />W oodhill Drive. <br /> <br />Prepared by: Thomas Paschke <br /> <br />Attachments: Property location map; site plan indicating proposed fence; and photos of parcel. <br />60-day Time Limit: Application received on August 14,2001.
