The plight of the landowner is due to circumstances unique to the property not <br />created by the landowner: The property is a corner lot that is given limited <br />development options within the front yard. In the case of the Freeman parcel, the <br />front yard is Huron Street; however, the principal structure, detached accessory <br />building, and the properties address result in a perceived front yard of W oodhill <br />Drive. The uniqueness of this property and the limited flexibility of the City <br />Code to deal with situations similar to that of the Freeman's have contributed to <br />the need for a variance <br /> <br />C. The variance, if granted, will not alter the essential character of the locality: <br />The proposed height variance will not alter the essential character of the locality, <br />nor adversely affect the public health, safety, or general welfare, of the city or <br />adjacent properties. <br /> <br />5.0 STAFF RECOMMENDATION <br /> <br />5.1 Based on the comments and findings outlined in Section 3 and 4 of this report, staff <br />recommends approval of the request for a two foot height variance to Section <br />1012.02B2 of the City Code, to allow the construction of a six foot tall fence in a <br />portion of the front yard of property located at 1296 Woodhill Drive. <br /> <br />6.0 PLANNING COMMISSION RECOMMENDATION <br /> <br />6.1 Planning Commission excerpt from Draft Minutes of September 12, 2001: <br /> <br />A request by Clinton Freeman, 1296lf7oodhill DriveJor a variance to Section iOi2.02B2 of the <br />Roseville City Code for allowance of a fence in a front yard greater than four feet. <br /> <br />Chair Jim Mulder opened the hearing and requested Dennis Welsch to provide a verbal summary <br />of the project report dated September i2, 200i. <br /> <br />Dennis Welsch explained that Mr. Freeman owns the home located at i296 Woodhill Drive. The <br />property is zoned R-i, Single Family Residential District with a Comprehensive Plan Designation <br />of LR, Low Density Residential. The Freeman property is surrounded by residential homes on the <br />north, south, east, and west. To the southeast lies Howard Johnson Park. The request includes a <br />variance }i'om Section i 0 i2. 02B2 of the Roseville Zoning Ordinance to increase the height of a <br />fence in afront yard to sixfeet. The Freeman lot is a corner lot withFontage along Woodhill <br />Drive and Huron Street. The Freeman home is addressed offofWoodhill Drive, which under City <br />Code is a side yard. The Font yard, as prescribed by the City Code, is that which Fonts along <br />Huron Street. In the case of the Freeman's the true front yard is used as a side yard. The <br />Freemans desire privacy and sound screen for their home and would like to construct a six-foot <br />tall fence Fom their south property line to the home.
