Kranz <br />Montpetit, Freiling & Kranz <br />Attorneys at Law <br />Suite 100 <br />222 Grand Avenue West <br />South Saint Paul, MN 55075-1139 <br /> <br />RE: James Te/stad variance Request. <br /> <br />Dear Mr. Kranz: <br /> <br />Thank you for the September 6, 200 I response and variance application submitted on behalf of <br />James Telstad, 2993 Fairview A venue, Roseville, Minnesota. However, the Community <br />Development Department has determined that the application is incomplete. Specifically, the <br />application did not include the necessary processing fee and there was no site plan submitted that <br />identified the existing lot size and conditions, setbacks, or the sizes of existing structures. <br /> <br />Prior to the Roseville City Council action on June 26, 200 I, the Community Development staff <br />did have conversations with Mr. Telstad regarding his proposal to replace an existing shed on his <br />property closer than five feet to a side property line. Our discussions centered on the existing <br />conditions of the propeliy and how Section 1004.0 I of the Roseville City Code impacts the <br />property. Staff also indicated that the City information and that provided by Mr. Telstad were <br />unclear to reach a concrete conclusion. To the best of our determination, five variances were <br />(are) necessary. These included variances to Sections 1004.01A3 (Detached Accessory Building <br />Size Limit), 1004.01A4 (Requirements for Increasing Maximum Size), 1004.01A5 (Overall <br />Area), 1004.01A6 (Maximum Total Surface Area), and 1004.01A8 (Minimum Setbacks). <br /> <br />The recently submitted application does include a narrative explaining Mr. Telstad's response to <br />"undue hardship", but the application does not include a site plan to allow the City to determine <br />which variances are necessary. Though the application does provide a narrative response to prior <br />questions/comments from the City pertaining to site coverage, a detailed site plan is necessary, as <br />indicated on the back of the application. <br /> <br />The Community Development Department is more than willing to work with Mr. Telstad on his <br />variance request or possible options.
