<br />2002 is vacant. Reco/Regan states that of its 10 vehicular repair and transportation <br />related tenants, most may not have proper permits under the existing codes and few <br />would be considered permitted uses in the new "B-6" zoning district. Because these <br />buildings are more than 34 years old, none of the buildings entirely meet the existing <br />zoning requirements. <br /> <br />3.0 ALTERNATIVES: <br /> <br />3.1 The Commission should discuss and consider all aspects of the property owners' <br />proposed permissive language amendments that provides for pre-existing uses to remain <br />and expand (even if nonconforming) in the "B-6" "Mixed Use Business Park District". <br /> <br />3.2 The Commission should provide the City Council with a recommendation to amend, <br />clarity, rewrite or retain the "B-6" "Mixed Use Business Park District" text. <br /> <br />4.0 STAFF RECOMMENDATION: <br /> <br />The Planning staff recommends retaining the existing text, which protects existing <br />uses as they operate today and allows additional permitted uses within the existing <br />building. In addition, retaining the existing text as proposed will provide <br />commitment to the adopted Twin Lakes Redevelopment Plan to assure that future <br />investment will be encouraged and protected. <br /> <br />Staff also recommends preparation of an additional policy document (draft <br />attached) that more clearly explains the pre-existing, nonconforming building and <br />land use review procedure. <br /> <br />5.0 SUGGESTED PLANNING COMMISSION ACTION: <br /> <br />By motion recommend to the Council, to retain the existing language in the "B-6" <br />zoning text as meeting the State Statues and City Codes and consistent with the <br />purpose and intent of the Comprehensive Land Use Plan definitions and <br />designations. <br /> <br />By motion, recommend adoption of a policy document (draft attached) which <br />explains the pre-existing, nonconforming building and land use review procedure. <br /> <br />Prepared by: Thomas Paschke (490-2236) and Dennis Welsch (490-2232) <br /> <br />Attachment: Proposed Ordinance. 60-day review not applicable. <br /> <br />PF3359 ~ RPCA(080702) Page 3 of 8 <br />
