2002 is vacant. Reco/Regan states that of its 10 vehicular repair and transportation
related tenants, most may not have proper permits under the existing codes and few
would be considered permitted uses in the new "B-6" zoning district. Because these
buildings are more than 34 years old, none of the buildings entirely meet the existing
zoning requirements.

3.0 ALTERNATIVES:

3.1 The Commission should discuss and consider all aspects of the property owners'
proposed permissive language amendments that provides for pre-existing uses to remain
and expand (even if nonconforming) in the "B-6" "Mixed Use Business Park District".

3.2 The Commission should provide the City Council with a recommendation to amend,
clarity, rewrite or retain the "B-6" "Mixed Use Business Park District" text.

4.0 STAFF RECOMMENDATION:

The Planning staff recommends retaining the existing text, which protects existing
uses as they operate today and allows additional permitted uses within the existing
building. In addition, retaining the existing text as proposed will provide
commitment to the adopted Twin Lakes Redevelopment Plan to assure that future
investment will be encouraged and protected.

Staff also recommends preparation of an additional policy document (draft
attached) that more clearly explains the pre-existing, nonconforming building and
land use review procedure.

5.0 SUGGESTED PLANNING COMMISSION ACTION:

By motion recommend to the Council, to retain the existing language in the "B-6"
zoning text as meeting the State Statues and City Codes and consistent with the
purpose and intent of the Comprehensive Land Use Plan definitions and
designations.

By motion, recommend adoption of a policy document (draft attached) which
explains the pre-existing, nonconforming building and land use review procedure.

Prepared by: Thomas Paschke (490-2236) and Dennis Welsch (490-2232)

Attachment: Proposed Ordinance. 60-day review not applicable.

PF3359 ~ RPCA(080702) Page 3 of 8
