ORDINANCE <br /> <br />Item Description: A request by the City of Roseville to amend text in Section 1008.1 OD If <br />and 1015.0lA of the Roseville City Code pertaining to majority vote <br />approval for planned unit developments and zonings (PF3353). <br /> <br /> <br />1.0 BACKGROUND <br /> <br />1.1 This past session the State Legislature amended Minnesota Statute 462.357, Subdivision <br />2 to eliminate the need for a 4/5 vote on planned unit developments and rezonings. The <br />new Statute allows these requests to be approved by a majority of the Council. However, <br />zoning changes from residential to commercial or industrial require a two-thirds majority <br />vote of all the members ofthe Council. <br /> <br />2.0 REVIEW of REQUEST <br /> <br />2.1 Because of this Legislative change, the City Attorney has recommended amending the <br />Roseville City Code (Zoning Ordinance) to conform with state law. <br /> <br />2.2 Attached is a draft ordinance that revises the necessary language in Sections 1008.1 OB 1 f <br />and l015.0lA of the Roseville City Code to be consistent with Minnesota Statutes <br />462.357, Subd. 2. <br /> <br />2.3 On November 14,2001, the Planning Commission, by a 5-0 vote, recommended approval <br />of the Ordinance modification to Sections 1008.l0BIfand 1015.0lA of the Roseville <br />City Code consistent with the attached draft ordinance. <br /> <br />3.0 STAFF RECOMMENDATION <br /> <br />3.1 Staff recommends holding the first reading, waiving the second reading, and then <br />approving the Ordinance modification to sections 1008.l0Blfand 1015.0lA of the <br />Roseville City Code. <br /> <br />4. 0 SUGGESTED CITY COUNCIL ACTION <br /> <br />4.1 Hold the first reading.
