<br />REQUEST FOR PLANNING COMMISSION ACTION <br /> <br />DATE: 11/14/01 <br />ITEM NO: 6d <br /> <br />Department Approval: Manager Approved: Agenda Section: <br />~ PUBLIC HEARING <br /> <br />Item Description: A request by the City of Roseville to amend text in Section 1008.10Dlf <br />and 1015.01 A of the Roseville City Code pertaining to majority vote <br />approval for planned unit developments and zonings (PF3353). <br /> <br />1.0 BACKGROUND <br /> <br />1.1 This past session the State Legislature amended Minnesota Statute 462.357, Subdivision <br />2 to eliminate the need for a 4/5 vote on planned unit developments and rezonings. The <br />new Statute allows these requests to be approved by a majority of the Council. However, <br />zoning changes from residential to commercial or industrial require a two-thirds majority <br />vote of all the members of the Council. <br /> <br />2.0 REVIEW of REQUEST <br /> <br />2.1 Because of this Legislative change, the Roseville City Code (Zoning Ordinance) must be <br />corrected. <br /> <br />2.2 Attached is a draft ordinance that revises the necessary language in Sections 1008.1 OB 1 f <br />and 1015.01A of the Roseville City Code to be consistent with Minnesota Statutes <br />462.357. Subd. 2. <br /> <br />3.0 STAFF RECOMMENDATION <br /> <br />3.1 Staff recommends approval of the Ordinance modification to sections 1008.1 OB 1 f and <br />1015.0lA of the Roseville City Code. <br /> <br />4.0 SUGGESTED PLANNING COMMISSION ACTION <br /> <br />4.1 By motion, recommend approval (approval with modifications or denial) of the <br />Ordinance modification to Sections l008.l0Blf and lOlS.OlA of the Roseville City <br />Code consistent with the attached draft ordinance. <br /> <br />Prepared by: Thomas Paschke (490-2236) <br /> <br />Attachments: Draft Ordinance, Excerpt f1'om Mn.
