<br />/" <br /> <br />landscaping, striping, and seal coating when and as required to conform to the <br />standard of maintenance described in Section 4.7, without cost or charge to the <br />ACRRA or the Council. All other maintenance, replacement of landscaping, and <br />repair and reconstruction of the Park and Ride Area shall be done by the Council <br />without cost or charge to the ACRRA or the Owner of the Northtown Parcel or <br />Mall Property. <br /> <br />4.6 Silma{!e~ Advertising. All signs placed On the Transit Hub Improvements or <br />otherwise placed by the Council or the ACRRA on the Council Parcel or the <br />No:rthtown Parcel in connection with the intended use of the Transit Hub <br />Improvements as a transit hub or for replacement transit facilities or a surface <br />parking facility, shall be placed, maintained, repaired, and replaced by the Council, <br />without cost or charge to the Owner of the Northtown Parcel or any lessee or <br />occupant of the Northtown Parcel or Mall Property, No signs shall be placed or <br />maintained upon the Transit Hub Improvements that are not directly related to the <br />Transit Hub Improvements or other public transit services, and all such signage <br />shan be subject to the prior approval of the Council and Northtown. Northtown <br />may place in designated display areas sign age which promotes events at the Mall <br />sponsored by Mall Management or the Mall Merchants Association. All such <br />signage shall be subject to the prior approval of the Council. No signage is <br />permitted which promotes a particular Mall retailer or retailers. <br /> <br />4.7 Standard of Maintenance and Repair. Northtown shall fulfill its obligations as <br />above set out in this Article at substantially the same time and upon substantially <br />the same schedule as it provides similar maintenance services to si:rr.ilar <br />improvements on the balance of the Mall Property. Maintenance of the Transit <br />Hub Improvements that is reasonably necessary to maintain scheduled transit <br />service operation shall receive highest priority. The Council shall perform its <br />obligations under this Article in a manner consistent with the standard of <br />maintenance and repair generally observed by Northtown in connection with those <br />buildings and improvements on the Mall Property. <br /> <br />4.8 Emer~ency Repairs. Any provision of this Agreement to the contrary <br />notwithstanding, if any repair to or maintenance of the Transit Hub Improvements <br />is not done by the party obligated by this Agreement to do such repair or <br />maintenance, and if, in the reasonable opinion of Northtown or the Council, an <br />emergency exists which requires that such repair and maintenance be done <br />immediately, then such repair and maintenance may be done by N orthtown or the <br />Council, and the cost, including reasonable attorneys' fees, may be recovered, upon <br />demand, by the party doing the repair or maintenance from the party obligated by <br />this Agreement to pay for the cost of the repair and maintenance. <br /> <br />ARTICLE V <br />CASUALTY lNS.URANCE~ RECONSTRUCTION: MODIFICATION <br /> <br />5.1 Casualty Insurance.
