<br />ARTICLE VI <br />USE <br /> <br />6.1 Use Not a Grant or Dedication. Use of the Transit Hub Improvements by <br />providers of public transit service and their passengers shall not be deemed to be a <br />dedication or otherwise a granting of any property rights to the public. <br /> <br />6.2 Use Regulations. The use of the Transit Hub Improvements shall be subject to the <br />following terms and conditions: <br /> <br />(a) No public transit vehicles using the Transit Hub Improvements shall wait or <br />park in any area in the Mall except in the Circulation Area; <br /> <br />(b) All passengers of public transit vehicles using the Transit Hub Improvements <br />shall unload and load only in the Circulation Area and at such places along <br />the Bus Route as are appropriately signed as stops for public transit vehicles. <br /> <br />(c) No public transit vehicles shall be washed, repaired, or maintained in any <br />part of the Mall, including, without limitation, the Circulation Area and the <br />Park and Ride Area, except, however, in an emergency and then only those <br />repairs shall be made which are necessary to allow removal of the public <br />transit vehicle from the Parcels. <br /> <br />(d) All public transit vehicles shall use the Transit Hub Improvements only for <br />the transportation and unloading and loading of passengers, and no public <br />transit vehicle shall park in the Circulation Area or the Park and Ride Area <br />for time durations in excess of the time needed to load and unload <br />passengers and to maintain or achieve the time schedule for that public <br />transit vehicle. <br /> <br />(e) Except to the extent permitted by Section 4.6 of this agreement, all <br />commercial advertising, retail sales, or other similar commercial activity, <br />except for newspaper v.ending machines, shall be prohibited on or in the Bus <br />Shelters and Pedestrian Walkway. <br /> <br />(f) Passengers of transit services shall have the non-exclusive right to park in the <br />Park and Ride Area. <br /> <br />6.3 Parking Enforcement. Vehicles that may be abandoned in the Park and Ride Area <br />or which are otherwise in violation of Northtown's parking and use regulations shall <br />be subject to removal or such other action as is used, from time to time, by <br />Northtown in its enforcement of its parking and use regulations at the Mall. If, <br />after notification by the Council of vehicles interfering with the use of the Park and <br />Ride Area, Northtown fails to enforce its parking and use regulations in the Park <br />and Ride Area, the Council may, as its sole remedy in connection with any such <br />failure, cause such vehicles to be removed from the Parcels.
