<br />.~ <br /> <br />"\ <br /> <br />I . ~fr..-c1.e..-- <br />Ii) /7'; //)<,/ <br />TRANSIT HUB AGREEMENTC f( ~/Q1;^.F) <br />eN orthtown) <br /> <br />. 1f... <br />THIS TRANSIT RUB AGREEMENT (lithe Agreement") is made as of the / () - <br />day of b A~ ' 1995, by and between the Anoka County Regional Rail Authority, a <br />political subdi . sion of the State of Minnesota (lithe ACRRA"), the Metropolitan Council, <br />a political subdivision of the State of Minnesota (lithe Councillt), and Nonhtown Mall <br />Partners, a California general partnership. ~ <br /> <br />WlTNESSEI'H: <br /> <br />WHEREAS, the Regiona.l Tra.nsit Board (lithe RTB") has provided a grant of funds <br />to the ACRRA for the purpose of generally establishing a public transit hub in a portion <br />of the surface parking facility for the Northtown Shopping Mall in Blaine, Minnesota <br />(hereinafter the "MaUlt); and <br /> <br />WHEREAS, on May 10, 1994, the Metropolitan Reorganization Act, 1994 <br />Minnesota Laws chapter 628, was enactedi and <br /> <br />'WHEREAS, the Metropolitan Reorganization Act provides that, effective October <br />1, 1994, the RTB is abolished and its duties, responsibilities, activities, property, interests, <br />and obligations are transferred to the Council; and <br /> <br />WHEREAS, on October 1, 1994, the RTB was in fact abolished by operation of the <br />Metropolitan Reorganization Act, and the Council has now succeeded to all of the rights <br />and obligations of the RTB, including those rights and obligations under the grant <br />agreement between the R TB and the ACRRA providing for establishment of the transit <br />hub; and ' <br /> <br />WHEREAS, the ACRRA, as a condition of the receipt of the grant, is required to <br />obtain a legally enforceable agreement that certain transit hub capital improvements will <br />be made, the transit hub will be available for public transit use, and sufficient parking area <br />will be made available for park and ride activities; and <br /> <br />VVHEREAS, it is intended that the transit hub and park and ride facility be located <br />partially upon real property owned by Northtown and partially upon property owned by <br />the ACRRA; and <br /> <br />WHEREAS, it is intended that the ACRRA will convey to the Council its property <br />upon which the transit hub and park and ride facility will be located; and <br /> <br />-1- <br /> <br />Z 'd lZV6'oN <br /> <br />^30 ~~O) 3NlVl8 All) <br /> <br />~V89:11 100Z '08'^ON <br />
