<br />2.2 On July 10, 2002, the Commission reviewed and discussed certain language <br />modifications pertaining to the inclusion of fencing within the current 75 foot setback. <br />The Commission considered a 20 foot setback from the ordinary high water mark (OHW) <br />and a fence (chain link or other) with only 25 percent opacity to a height of 42 inches. <br /> <br />2.3 The Community Development Staff sees validity in allowing a fence, 42 inch in height, of <br />either chain link (epoxy or vinyl coated) or a picket fence or similar to a point no closer <br />than 20 feet to a lakes ordinary high watermark or the established bluff line, and 10 feet <br />from a delineated wetland boundary. <br /> <br />2.4 In the case of the lakeshore lot, the 20 foot distance is the same setback requirement that <br />water oriented accessory structures are allowed to be placed and affords each property <br />owner an area that could be landscaped to augment the property and shield the fence <br />(partially) from a lake view. <br /> <br />2.5 Although pools are not specifically addressed in Section 1016 of the Roseville City Code, <br />the Community Development Department has determined that an above ground pool is a <br />structure, which would be required to meet the existing 75 foot structure setback from the <br />ordinary high watermark of a lake and 50 feet from a wetland delineated boundary. <br />Further, a pool is required in the State Building Code (and Section 905 of the Roseville <br />City Code) to have a five foot tall fence that completely encloses the pool. Should a <br />resident desire an above ground pool within the required 75 foot setback distance, a <br />variance would be necessary. (In-ground pools are considered a permitted portion of the <br />landscape much like patios, but are restricted to a 20 foot minimum shoreline and <br />bluffline setback and must be fenced as per the building code for life safety purposes.) <br /> <br />2.6 The City Council has determined that a typical privacy fence is a structure which must <br />meet the current setback requirement of75 feet from the OHW, or be at a point no closer <br />than the existing home or deck.
