1 2 3 ORDINANCE NO. 4 5 AN ORDINANCE AMENDING TITLE 10, SECTION 1016, SHORELAND 6 DISTRICT, BY ADDING LANGUAGE WHICH DEFINES FENCES AS 7 STRUCTURES WHEN PLACED IN THE SHORELAND DISTRICT AND 8 PROHIBITS PLACEMENT OF FENCES SHOREWARD OF THE PRINCIPAL 9 STRUCTURE OR ANY PERMITTED DECK. 10 11 THE CITY OF ROSEVILLE ORDAINS: 12 13 SECTION 1. Purpose. The Roseville City Code, Title 10, Section 1016, is hereby 14 amended by adding or revising language necessary to define fences as structures within 15 the Shore1and District and to provide additional regulation regarding their placement on 16 property with water frontage. The purpose of this ordinance is to provide visual access, 17 private open space, and reduced impacts of man-made structures within the non-buildable 18 portion of the Shore land District, between the principal structure and the shore line. 19 20 SECTION 2. Section 1016.05 (Definitions) is hereby amended as follows: 21 22 STRUCTURE: Any building or appurtenance, including attached or detached 23 decks and fences. "Structure" does not include aerial or underground utility lines, 24 such as sewer, electric, telephone, telegraph, gas lines, towers, poles, seasonal 25 docks, and other supporting facilities such as at-grade driveways and patios. 26 27 SECTION 3. Section 1016.16 B. (Additional Structure Standards For All Districts) is 28 hereby amended by adding the following subsection 3 as follows: 29 30 Section 1016.16 B 3. Except for chain link type fences addressed below, in bluff 31 impact, shore land, and wetland zones, fences shall be setback the same distance 32 from the shore line as required for the principal structure or attached deck on the 33 lot, except that a fence on a lot with a pre-existing principal structure and attached 34 deck may extend to the same setback as the deck or the structure. Except for chain 35 link type fences addressed below, fences shall be of similar design, texture, and 36 color as the principal structure or shall be of an earth tone or color and material. 37 38 With the exception of regulations in this subsection, fences in bluff impact, 39 shoreland, and wetland zones shall meet all height and setback requirements of the 40 City Code, Section 1012.02. Fences placed on the road side ofa lot with water or 41 wetland frontage shall comply with front yard fence requirements of City Code, 42 Section 1012.02. 43 44 Notwithstanding the restrictions specified above, chain link type fences may be 45 placed in bluff impact, shore land and wetland zones if the fence does not exceed 46 forty two inches (42") in height and has at least seventy five percent (75%) open 47 space for passage of air and light inside the ordinary high-water level setback. 48 Fences shall not be located within twenty feet (20') from the ordinary high-water 49 mark or ten feet (10) from a delineated wetland. 50 51
