2.4 Although pools are not specifically addressed in Section 1016 of the Roseville City Code,
the Community Development Department has determined that a pool is a structure, which
would be required to meet the existing 75 foot structure setback from the ordinary high
watermark of a lake and 50 feet from a wetland delineated boundary. Further, a pool is
required in the building code and Section 905 of the Roseville City Code, to have a five
foot tall fence that completely encloses said pool. Should a resident desire a pool within
the required setback distance, a variance would be necessary.

3.0 STAFF RECOMMENDATION:

3.1 The City Planner suggests that the Planning Commission open the public hearing, invite
citizen comments, discuss/consider the comments of Section 2 of this project report, and
develop a recommendation for the City Council to consider for inclusion in the second
and final reading of the ordinance amendment to Section 1016 of the Roseville City Code
on July 17, 2002.

4.0 SUGGESTED ACTION:

4.1 Seek public input and by motion, make a recommendation on whether specific
language is necessary regulating certain fence types, heights, and locations for
parcels adjacent shoreland and wetland areas.

Prepared by: Thomas Paschke (651-490-2236)

Attachments: proposed ordinance amendments.

PF3362 RPCA - 071002 Page 2 of2
