While your proposed home <br />addition will encroach into the 75 foot shorcland setback, it has been determined that a variance <br />will not be necessary. <br /> <br />Section 1016.16A reads: Placement of Structures on Lots: When more than one setback <br />applies to a site, structures andfacilities shall be located to meet the most restrictive <br />setbacks. Where structures exist on the adjoining lots on both sides of a proposed <br />building site, structure setbacks may be altered without a variance to conform with the <br />average setback of adjoining structures fi'om the ordinalY high water level, provided the <br />proposed building site is not located in a shore impact zone or in a bluflimpact zone. <br /> <br />Given this administrative latitude, I have detelmined that the nearest point of the westem <br />structure to the shoreline is 62 feet and the nearest point on the eastern structure to the shoreline <br />is 51 feet, for an average of 58.5 feet. Your proposed addition is not in a shore or the bluff <br />impact zone, thus it would be allowed to be placed 67 feet from the OHW as proposed without a <br />vanance. <br /> <br />However, before the project gets too far along, I believe that it is in the best interest of this <br />request to seck comments from Marlyne Anklan, 3153 Sandy Hook Drive. I would ask that you <br />discuss the proposed porch addition with Ms. Anklan and ask that she contact me with her <br />comments. <br /> <br />I am retuming your original paperwork/plans to you and I will forward a copy of the proposal to <br />Gerry Proulx, Residential Building Inspector.
