<br />12.050 <br /> <br />ZONING CODE <br /> <br />12.030. Procedure for Special Use Permit. <br />Any owner of land may file an application for a Special Use Per- <br />mit by paying the amount set forth in Section 15.030, and by <br />providing the City with an Abstractor's certified Property <br />Certificate showing the property owners within 350 feet of the <br />outer boundary of the parcel of land on which the Special Use <br />Permit is requested. The application shall then be heard by the <br />Planning Commission, then by the Council, upon the same <br />published notice, mailing notice and hearing procedure as set <br />forth in Sections 16.020 and 16.030, except that the notices <br />shall contain the description of the land and the kind of <br />special permit involved. <br /> <br />12.035. criteria for Issuance of Special Use Permit. <br />When reviewing an application for a Special Use Permit, the <br />Planning Commission and Council shall consider the following <br />criteria: <br /> <br />1. Impact on traffic. <br />2. Impact on parks, streets, and other public facilities. <br />3. Compatibility of the site plan, internal traffic circula- <br />tion, landscaping and structures with contiguous properties. <br />4. Impact of the use on the market value of contiguous <br />properties. <br />5. Impact on the general public health, safety and welfare. <br />6. Compatibility with the city's Comprehensive Plan. <br /> <br />The Council may attach reasonable conditions to the Special Use <br />Permit. The addition of such conditions shall constitute a <br />finding that the conditions are necessary and reasonable. <br /> <br />12.040. Variances for Hardship. <br />Where there are practical difficulties or unusual hardships in <br />the way of carrying out the strict letter of the provisions of <br />this Code, the Council shall have the power, in a specific case <br />and after notice and public hearing, to vary any such provision <br />in harmony with the general purpose and intent thereof, and may <br />impose such additional conditions as it considers necessary so <br />that the public health, safety and general welfare may be <br />secured and substantial justice done. <br /> <br />12.050. Procedure for Variances. <br />Any owner of land may file an application for a variance by <br />paying the amount set forth in section 15.030 with an <br />Abstractor's Certified Property certificate showing the property <br />owners within 250 feet of the outer boundaries of the parcel of <br />land on which the variance is requested. The application shall <br />then be heard by the Planning Commission upon the same published <br />notice, mail ing notice and hearing procedure as set forth in <br />section 16.020. The matter shall then be heard by the Council <br />without a public hearing. <br /> <br />75 <br />
