<br />FREDRIKSON & BYRON, P.A. <br />Attorney.; and Advisors <br /> <br />Mr. Thomas Paschke <br />October 30,2001 <br />Page 2 <br /> <br />To provide the Northerly Lot with substantially equivalent access to Hamline as was <br />contemplated in the 1993 Lot Division, we could proceed in one of two ways: (i) create an <br />easement for access for the benefit of the Northerly Lot, from and to Hamline Avenue, over a <br />portion of the Southerly Lot; or (ii) modify the existing boundary between the Northerly Lot and <br />the Southerly Lot to provide each with frontage on Hamline Avenue. <br /> <br />Mr. Willmus would prefer to leave the boundary lines between the Northerly Lot and the <br />Southerly Lot as they presently exist, with the Northerly Lot having access to Hamline Avenue <br />over a driveway easement across a portion of the Southerly Lot. Mr. Willmus is willing, <br />however, to modify the boundary lines between the Northerly and Southerly Lots to provide the <br />Northerly Lot with direct access to Hamline Avenue, if the City prefers that approach. If the <br />latter course is taken, I suggest that the new subdivision be undertaken in the form of a <br />Registered Land Survey, so that each lot can continue to enjoy a simple legal description. <br /> <br /> <br />You will find enclosed two drawings of the subject properties. The first drawing shows the <br />existing boundary lines between the Northerly Lot and Southerly Lot, and the location of a <br />proposed access easement in favor of the Northerly Lot. The second drawing shows how the <br />boundary between the Northerly Lot and Southerly Lot could be modified to provide each lot <br />with direct access to Hamline Avenue.
