<br />November 14,2001 <br /> <br />City ofRoseville <br />Planning Commission Chairman <br />2660 Civic Center Drive <br />Roseville, ivIN 55113 <br /> <br />re: Re buttal for Staff Report <br />Brad Hoff - 1897 Shady Beach Ave., Roseville MN 55113 <br />Planning File #3347 <br /> <br />Dear <br /> <br />There is a loophole in the Roseville Building Code to build a plastic fence to shoreline. <br /> <br />It is a "taking without compensation" on the entire lake and the city itself. <br /> <br />Staff Report - August 1990 <br /> <br />"Variance approved by the City Council did not include an allowance for a 6 12' tall fence. Length of <br />fence was 43 feet and did not obstruct the view of the lake. Now it is 165 feet in length. <br /> <br />Building Code <br /> <br />People who live on lakes call that portion that faces the lake their front yard - ordinance should <br />address shoreline, not backyards abutting the lakeshore. <br /> <br />. Paragraph 2.2 - Building pennit was issued in error, so the city is trying to get off the hook for <br />damages. <br />. Paragraph 2.3 - "Inadvertent error" on Building Permit AO 1-282 <br />. Paragraph 3.3 - Installed the existing 6 Yz' tall white plastic fence in violation of Section <br />10 12.02B2 of Roseville Code. <br />. Paragraph 3.6 - Minnesota DNR - DNR says it is tragic and poses environmental issues. <br />. Paragraph 3.7 - Our bathroom and bedroom face the street; we have blinds. <br />.
