<br />Re-typed from hand written <br />faxed copy from Mr. Shiely (color emphasis by Dennis) <br /> <br />A copy of the handwritten fax from Mr. Shiely will be forwarded to the City Manager. <br /> <br />From: Dispute Resolution Center, 974 W. 7th St., St. Paul, MN 55102 <br /> <br />Mediation Agreement, held Feb. 4, 2002: <br /> <br />Dan Shiely and Frank Hess will agree to variances for the front yard fences. The one already <br />built on the west side, and one of the same dimension and material, replacing the current cedar <br />fence on the east side. Brad Hoff will remove eight (8) panels (6 feet) on the west (Shiely) side <br />of the shoreline fence out seven (7) panels (56' minimum) on the east (Hess) side of the shoreline <br />fence. This will be completed within 60 days after receipt of payment from the city of Roseville, <br />payment being a reimbursement for costs incurred by Mr. Hoff. Demolition can be guaranteed <br />time wise, but the front fence may take time. Mr. Hoff agrees to call the fencing contractor by <br />Feb. 11th to schedule the work. <br /> <br />Mr. Shiely and Mr. Hess agree to address any problems with dogs in Hoffs yard when and if that <br />becomes a problem. They will guarantee _ foot setback from Hoff s property line and <br />swimming pool installed.
