REQUEST FOR CITY COUNCIL ACTION

DATE: 11/26/01
ITEM NO: L-l

Agenda Section:
L\ND USE

A request by Bradley Hoff, 1897 Shady Beach Avenue, for a Variance to
Section 1012.02B2 of the Roseville City Code (PF3347)

1.0 REQUESTED ACTION

1.1 Mr. Hoff has requested a 2-1/2 foot variance to Section 1012.02B2 (Certain Structures
Not Considered Encroachments) to allow a recently installed fence to be 6-1/2 feet tall in
a front yard.

Existin
6-112 foot hei

ard

Variance Re uested
2-112 feet

PROJECT REVIEW HISTORY
· Application accepted on 10/02/01.
· 60-day review deadline on 12/01/01.
· Staff Review: Approval with conditions ......11/14/01.
· Planning Commission Recommendation: Denial w/findings - 11/14/01.

2.0 BACKGROUND

2.1 On August 13,1990 Mr. Hoff received a minor variance to allow construction ofa
detached garage five feet from the front property line. The minor variance process (no
longer used by the City) required the signatures of adjacent property owners supporting
the variance being requested. Mr. Ii.off did receive the necessary signatures and City
support for the 25-foot front yard setback encroachment. The minor variance site plan
(attached) included the other improvements that would occur on the property, including
the installation of a retaining wall and installation of a fence. However, the minor
variance approved by the City Council did not include an allowance for a 6-1/2 foot tall
fence.

2.2 In April 2001, the Community Development Department issued a building pennit to Mr.
Hoff for the replacement and expansion of his existing wood fence to the shoreline of
Lake McCarrons. However, this building pennit was issued in error. The inspector who
reviewed and issued the fence replacement/addition permit inadvertently overlooked
Section 1012.02B2 and its four foot maximum fence height allowance in a front yard.
Upon becoming aware of this error, the inspector notified the contractor of the height
limit for the section in the front yard.

PF3347 ReA 112601 Page 1 of 5
