May 23,2001

Joel Cheney
5506 Jenni Lane
White Bear Lake, MN 55110

Mr. Dennis P. Welsch
Community Development Director
City of Roseville
2660 Civic Center Drive
RoseviIle, MN 55113

Dear Mr. Welsch,

On the 9th of April, 2001 my wife and I filed a Setback Permit Application for building a
house on our lot at the corner of Acorn and County Road B. On May 9th we were notified
by letter that our application was approved. During the process our neighbor to the east,
Mr. George LeTendre, pettioned the city to deny the permit request as it applied to the
north end of the property, stating in his petition that he had no objection to the application
as it petained to the west side of the property. Subsequent to receiving the notice of
approval we received a letter indicating that Mr. LeTendre was appealing the decision of
the Development Review Committee to the city council. This letter is to notify you that
we are cancelling or withdrawing that part of the application pertaining to the north end
of the lot. We now intend to build within the normal setback on the north (30') and the
approved setback on the west (26'). We assume that this eliminates the basis for Mr.
LeTendre's appeal and we can proceed with the process of getting a building permit.

We want to thank you and your staff, especially Mr. Thomas Paschke, for the
professional and courteous treatment you have extended to us during this process.

Sincerely,

Joel Cheney
