March 15,2002

City of Roseville
Community Development Dept.
2660 Civic Center Drive
Roseville, MN 55113

Attn: Thomas Paschke

Re: Item 9. A. of the Variance Application

Thank you for your review and approval of our application for a pennit to have a privacy fence
constructed on our property at 1800 Lindy Ave. Pursuant to your letter indicating that City Code
does not allow placement of our fence less that 30 feet from the northern property line due to traffic
visibility at the service road intersection, we would like to request a variance to Roseville City
Code Section 1012.03 as it applies to our situation.

As you are aware, our property is on a comer lot and backs up to Robert Paul TV on Lexington
Ave. Between our back yard and the Robert Paul building is a service road and it is the traffic
traveling on this road which is of issue. Realizing that city code requires a 30 foot approach to
maintain a clear view at the intersection, we respectfully submit a request to reduce that to 10 feet
or less inside the property line at this approach. This particular traffic approach from the south is
severely slanted as is our property, meaning that drivers approach this intersection at a significant
uphill grade. It seems that a fence placed 10 feet or less inside the north property line should allow
for clear visibility at the service road intersection. The property line is located roughly in the
center of the hill described.

Placing the fence 30 feet inside the property would pose a hardship to us and suppress the
effectiveness ofthe fencing in meeting the following needs.

. Protect the safety of our infant child and fhture children from the motor and foot traffic from
the service road. People tend to drive fast on this service road which presents a serious safety
concern. In terms of the foot traffic, we have had problems with people walking through our
yard from this road as well as juveniles using the rear of our back yard for drinking alcohol and
other inappropriate activities. This too, is the cause of tremendous concern to us.

. Reduce or elinlinate the amount of garbage which comes into our yard from the retail
businesses as well as pedestrians, including the juveniles mentioned above who leave beer
bottles, cans, cigarette butts and other trash in our rear yard on a regular basis.

. Provide screening from the retail businesses as well as reduce the amount of street noise we are
exposed to.

Thank you for your consideration. Please contact me with any questions you may have.
I can be reached at 651-489-3057.

Sincerely,
