When: If approved by early summer of any year, bus shelters can be installed
before the cold weather of the late fall (mid November). It normally takes 90 days from
Permit approval to completed installation. By contract, the shelter normally stays in place
for ten years, with 2 five-year options to extend the shelter, but the length of stay can be
amended.

Legality: Bus benches are currently allowed by the City Code, Section 703.05. The
current regulations, adopted in 1983, allow a bench (7' long, 3' high and 3 ' wide) to be
placed at 1,000 foot intervals along existing bus routes and only in bus stop locations.
Advertising is allowed on the back rest of the bench. A $25.00 permit is required for each
bench and insurance and city indemnification is required. Written permission from other
agencies with jurisdiction is required. Amendments to the existing city regulation
would be required to allow a shelter vs. a bench.

The Sign Section (l009.03F) of the City Code states that bus bench signs are exempt for
the sign code.

State Statute Requirements investigated by City Attorney

Maintenance: Outdoor Promotions, by contract with the City, would be
responsible for all maintenance, with a clean-up schedule twice per week and snow
shoveling after each snow. The company sometimes does subcontract portions of the
maintenance program. The shelter and walkways are power washed once per month. The
company also is responsible for repair and replacement within 48 hours of each
occurrence. Currently, Outdoor Promotions is evaluating snow melting and heating
features.

Advertising: Advertising pays for this service. The shelters have 2 exterior
advertising panels, no more than four feet by six feet in area each. A panel can also be
installed for City or public use. The advertising content (by contract) is very limited and
does not include alcohol or tobacco products, vulgar or indecent messages, politics or
religion.

Metro Transit Responses: Supportive, but no formal response

Q:\Planning Files\3389 _Bus Shelters'Bus and Transit Shelter Proposal(0201 02).doc
