<br />1 DRAFT (11/18/02) <br /> <br />2 N on Exclusive Transit Stop Shelter Franchise <br /> <br />3 ORDINANCE NO. <br />4 <br />5 AN ORDINANCE ESTABLISIDNG A NON-EXCLUSIVE TRANSIT SHELTER <br />6 FRANCIDSE AGREEMENT <br />7 <br />8 THE CITY OF ROSEVILLE CITY COUNCIL ORDAINS: <br /> <br />9 Purpose. The City desires to implement a program (the "Transit Shelter Program") <br />10 pursuant to which illuminated transit shelters will be installed and maintained in <br />11 compliance with this Franchise Ordinance at certain transit stop sites to be identified <br />12 from time to time by the City, Transit Authority, and franchisee. The franchisee is in the <br />13 business of installing and maintaining illuminated transit shelters and it has submitted its <br />14 proposal to the City to provide its services with respect to the Transit Shelter Program. <br />15 The City desires to engage the services of the franchisee with respect to the Transit <br />16 Shelter Program upon the terms, covenants and conditions hereinafter set forth. <br /> <br />17 Section 1. Grant. <br /> <br />18 Acting pursuant to the authority granted to the City of Roseville by the Minnesota State <br />19 Legislature pursuant to Minnesota Statutes, Section 160.27, Subdivision 2, the Council of <br />20 the City of Roseville does hereby grant to (hereinafter referred to <br />21 as "Company") a nonexclusive transit stop shelter franchise subject to all the terms and <br />22 conditions set forth in this franchise ordinance. <br /> <br />23 Section 2. Rights and Privileges of Company. <br /> <br />24 The franchise granted by the City shall grant to the Company the right to install, repair, <br />25 and maintain transit shelters with affixed advertising, at active transit stop sites within the <br />26 City of Roseville, as illustrated in Appendix A, on any street, and county road and state <br />27 highway right-of-way with proper permits, at the Company's sole cost and expense for <br />28 the convenience and comfort of persons waiting for transit. The transit shelters and <br />29 advertising displayed thereon shall be subject to the limits and conditions set forth in this <br />30 franchise ordinance and Section 703.05 of the City Code of the City of Roseville, as may <br />31 be amended from time to time by the City pursuant to this agreement. <br /> <br />32 Section 3. Agreement. <br /> <br />33 Upon adoption of this franchise ordinance and execution of the acceptance thereof by the <br />34 Company, the Company agrees to be bound by all the terms and conditions contained <br />35 herein. The Company also agrees to provide all services set forth in its application and by <br />36 its acceptance of the franchise, Company specifically agrees that the Company's <br />37 application is thereby incorporated by reference and made a part of this franchise <br /> <br />1 <br />
