1 DRAFT (11/18/02) 2 N on Exclusive Transit Stop Shelter Franchise 3 ORDINANCE NO. 4 5 AN ORDINANCE ESTABLISIDNG A NON-EXCLUSIVE TRANSIT SHELTER 6 FRANCIDSE AGREEMENT 7 8 THE CITY OF ROSEVILLE CITY COUNCIL ORDAINS: 9 Purpose. The City desires to implement a program (the "Transit Shelter Program") 10 pursuant to which illuminated transit shelters will be installed and maintained in 11 compliance with this Franchise Ordinance at certain transit stop sites to be identified 12 from time to time by the City, Transit Authority, and franchisee. The franchisee is in the 13 business of installing and maintaining illuminated transit shelters and it has submitted its 14 proposal to the City to provide its services with respect to the Transit Shelter Program. 15 The City desires to engage the services of the franchisee with respect to the Transit 16 Shelter Program upon the terms, covenants and conditions hereinafter set forth. 17 Section 1. Grant. 18 Acting pursuant to the authority granted to the City of Roseville by the Minnesota State 19 Legislature pursuant to Minnesota Statutes, Section 160.27, Subdivision 2, the Council of 20 the City of Roseville does hereby grant to (hereinafter referred to 21 as "Company") a nonexclusive transit stop shelter franchise subject to all the terms and 22 conditions set forth in this franchise ordinance. 23 Section 2. Rights and Privileges of Company. 24 The franchise granted by the City shall grant to the Company the right to install, repair, 25 and maintain transit shelters with affixed advertising, at active transit stop sites within the 26 City of Roseville, as illustrated in Appendix A, on any street, and county road and state 27 highway right-of-way with proper permits, at the Company's sole cost and expense for 28 the convenience and comfort of persons waiting for transit. The transit shelters and 29 advertising displayed thereon shall be subject to the limits and conditions set forth in this 30 franchise ordinance and Section 703.05 of the City Code of the City of Roseville, as may 31 be amended from time to time by the City pursuant to this agreement. 32 Section 3. Agreement. 33 Upon adoption of this franchise ordinance and execution of the acceptance thereof by the 34 Company, the Company agrees to be bound by all the terms and conditions contained 35 herein. The Company also agrees to provide all services set forth in its application and by 36 its acceptance of the franchise, Company specifically agrees that the Company's 37 application is thereby incorporated by reference and made a part of this franchise 1
