The length of a shelter shall <br />3 be determined by the Public Works Director and shall be dependent upon the number <br />4 of buses or vehicles and users that frequent the bus stop. <br />5 <br />6 F. Color: A bench or shelter shall be of a single color except a multicolored advertising <br />7 sign. The bench signage may be affixed to or may be used as the backrest of the <br />8 bench. The shelter signage may be up to two (2), four feet (4') by six feet (6') <br />9 advertising panels in a 2-sided 'V' display affixed to the end wall of the shelter (or <br />10 road wall on a narrow right-of-way application) and perpendicular to the roadway <br />11 curb or edge viewable from one or both end$ of the shelter. The Public Work~ <br />12 Director shall detemline the location of shelters to assure line of sight and traffic <br />13 safety. Signage on benches and shelters shall require pennits as required by Chapter <br />14 1009. <br />15 <br />16 G. Structure Maintenance: Benches and shelters shall be equipped with an <br />17 architecturally complimentary trash receptacle to be emptied weekly or as frequently <br />18 as necessary bv the vendor to complv with the City's health, safetv and welf~1re <br />19 concems. <br />20 <br />21 H. Liability Insurance: A certificate of liability insurance shall be filed with the City <br />22 covering claims for damages which might arise out of the use or placement of a bench <br />23 or shelter in the public right of way naming the City as an additional insured. The <br />24 minimum limit ofliability shall be six hundred thousand dollars ($600,000.00). <br />25 <br />26 1. If the location of the bench or shelter is a safety hazard or if it interferes with <br />30 pedestrian or vehicular traffic on the right of way, or if the bus route changes_ the <br />31 provider shall incur the cost of removal within 30 days of the route change. <br />32 <br />33 J. State Or County Permission: If the bench or shelter placement is in a Minnesota <br />34 Department of Transportation or County right of way, written permission must be <br />35 secured from the Minnesota Department of Transportation or the County and filed <br />36 with the City. (Ord. 921,2-14-1983; 1995 Code) <br />37 <br />38 SECTION 3. Section 1009.03 is hereby amended as follows: <br /> <br />39 F. Public Ways: Signs shall not be permitted within the public right of way or easements <br />40 except on benches and bus shelters which have received permits as per Section <br />41 703.05 , and newspaper and cabstands, all of which shall be as govemed by Section <br />42 901 and Section 703.05 of this Code; and real estate signs and political signs as <br />43 regulated in this chapter. City, county and state traffic directional signs are permitted. <br /> <br />44 SECTION 4. Effective Date. This ordinance shall take effect following its passage and <br />45 publication. <br />46 <br />
