<br />REQUEST FOR PLANNING COMMISSION ACTION <br /> <br /> <br />Date: 05/01102 <br />Item No: <br />City Manager: Section: <br />PUBLIC HEARING <br /> <br />Proposed Ordinance Amending Chapter 10, Sections 1005 and 1002 of the <br />City Code by Adding Regulations relating to Sexually Oriented Business <br />Uses (PF3394) <br /> <br />1.0 BACKGROUND <br /> <br />1.1 Currently the City of Roseville does not have any Code regulations relating to sexually <br />oriented business uses in the City, other than through minimal regulation in the licensing of <br />liquor establishments. <br /> <br />1.2 According to a State Attorney General's Report, neighborhoods located near sexually <br />oriented businesses experienced increased transience and decreased stability of ownership. <br /> <br />2.0 STAFF RECOMMENDATIONS: <br /> <br />2.1 Due to recent changes in technology, court cases and business practices concern has been <br />expressed about the minimal regulation in the City Code as well as the lack of other <br />official controls adequate in scope to accomplish preservation ofthe City's standards. <br /> <br />2.2 An Interim Ordinance creating a moratorium on establishment of new sexually oriented <br />businesses was adopted by the City Council on April 22, 2002 to allow time for Planning <br />Commission and Council review of the facts and creation of regulations. This moratorium <br />expires in July, 2002. <br /> <br />2.3 The City Attorney and Staff are recommending that the Planning Commission and <br />Council: 1) study the facts and adopt a resolution of findings of fact, and 2) adopt an <br />ordinance (attached) for the purpose of defining the use and regulating the location of <br />sexually oriented businesses in "B" and "I" zones. Separation from any residential zone <br />or "B-1" zone (which may include residential units) would be required. <br /> <br />3.0 SUGGESTED ACTION: <br /> <br />3.1 Adopt a resolution of findings of fact regarding effects of sexually oriented businesses. <br /> <br />3.2 By motion, recommend adoption of an ordinance which adds new language and <br />regulation in the City's official controls relating to sexually oriented business uses, <br />including the City's zoning and land use regulations. <br /> <br />Attachments: Draft Resolution and Proposed Ordinance, Map illustrating potential areas of use <br /> <br />PF3394 RPCA - ORDINANCE 050102 Page 1 <br />
