<br />REQUEST FOR CITY COUNCIL ACTION <br /> <br />Date: 04/22/02 <br />Item No: 1It[:.. A. <br />Agenda Section: <br />ORDINANCE <br /> <br />Proposed Ordinance Amending Chapter 10, Sections 1005 and 1002 of the <br />City Code by Adding Regulations relating to Sexually Oriented Business <br />Uses (PF3394) <br /> <br /> <br />1.0 BACKGROUND <br /> <br />1.1 Currently the City of Roseville does not have any Code regulations relating to sexually <br />oriented business uses in the City, other than through minimal regulation in the licensing of <br />liquor establishments. <br /> <br />1.2 According to a State Attorney General's Report, neighborhoods located near sexually <br />oriented businesses experienced increased transience and decreased stability of ownership. <br /> <br />2.0 STAFF RECOMMENDATIONS: <br /> <br />2.1 Due to recent changes in technology, court cases and business practices concern has been <br />expressed about the minimal regulation in the City Code as well as the lack of other <br />official controls adequate in scope to accomplish preservation of the City's standards. <br /> <br />2.2 The City Attorney and Staff are recommending that an interim ordinance be adopted for <br />the purpose of protecting the planning process and the health, safety and welfare of the <br />citizens of the City and to ensure that the City and its citizens retain the benefits of the <br />City's Comprehensive Plan and City Code until a study has been completed and any <br />modifications to the City Code's land use regulations are accomplished. <br /> <br />3.0 SUGGESTED CITY COUNCIL ACTION: <br /> <br />3.1 By motion, direct that a study be undertaken to address changes in the City's official <br />controls relating to sexually oriented business uses, including the City's zoning and land <br />use regulations. <br /> <br />3.2 Hold the first reading of the Interim Ordinance and by motion waive the second reading. <br /> <br />3.3 By motion, approve the Ordinance entitled "An Interim Ordinance Placing Temporary <br />Restrictions On The Siting Of Sexually Oriented Uses Within Any Zoning District Of <br />The City Of Roseville". <br /> <br />PF3394 RCA - ORDINANCE 042202 Page 1 <br />
