Agenda Section: ORDINANCE Proposed Ordinance Amending Chapter 10, Sections 1005 and 1002 of the City Code by Adding Regulations relating to Sexually Oriented Business Uses (PF3394) 1.0 BACKGROUND 1.1 Currently the City of Roseville does not have any Code regulations relating to sexually oriented business uses in the City, other than through minimal regulation in the licensing of liquor establishments. 1.2 According to a State Attorney General's Report, neighborhoods located near sexually oriented businesses experienced increased transience and decreased stability of ownership. 2.0 STAFF RECOMMENDATIONS: 2.1 Due to recent changes in technology, court cases and business practices concern has been expressed about the minimal regulation in the City Code as well as the lack of other official controls adequate in scope to accomplish preservation of the City's standards. 2.2 The City Attorney and Staff are recommending that an interim ordinance be adopted for the purpose of protecting the planning process and the health, safety and welfare of the citizens of the City and to ensure that the City and its citizens retain the benefits of the City's Comprehensive Plan and City Code until a study has been completed and any modifications to the City Code's land use regulations are accomplished. 3.0 SUGGESTED CITY COUNCIL ACTION: 3.1 By motion, direct that a study be undertaken to address changes in the City's official controls relating to sexually oriented business uses, including the City's zoning and land use regulations. 3.2 Hold the first reading of the Interim Ordinance and by motion waive the second reading. 3.3 By motion, approve the Ordinance entitled "An Interim Ordinance Placing Temporary Restrictions On The Siting Of Sexually Oriented Uses Within Any Zoning District Of The City Of Roseville".
