4.0 BACKGROUND:

4.1 Mr. Dahmann owns property at 1055 Shryer Avenue. The property is zoned R-1, Single
Family Residential, and the Comprehensive Plan identifies the property as Low Density
Residential.

4.2 Mr. Dahmann desires to tear down an existing dilapidated 18 foot by 18 foot (324 sq. ft)
detached accessory structure and construct a new 32 foot by 30 foot (960 sq. ft) detached
accessory building in the same general location. Mr. Dahmann also wants to keep
another detached accessory building in his rear yard that is 25.5 feet by 18 feet (459 sq.
ft.).

4.3 Mr. Dahmann has submitted a narrative that discusses his position regarding need and
hardship related to the proposed garage.

4.4 The proposed detached garage would be constructed at the terminus of the existing
driveway, just east of the existing structure. Mr. Dahmann does not have a garden shed.

SECTION 1004.01A4
VARIANCE
Code Re uirement
Accessory Building
Size

Code Maximum
1008 sq. ft.
CUP

Variance Re uested
411 sq. ft.
and CUP

4.5 Section 10004.01A4 of the City Code describes the criteria under which a conditional use
permit (CUP) may be evaluated. They are as follows:

· Impact on traffic.
. Impact on parks, streets and other public facilities.
. Compatibility of the site plan, internal traffic circulation, landscaping and
structures with contiguous properties.
· Impact of the use on the market value of contiguous properties.
. Impact on the general public health, safety and welfare.
. Compatibility with the City's Comprehensive Plan.

4.6 The CUP process also allows the City to impose those conditions it considers necessary
to protect the public health, safety, and welfare.

4.7 The Conmmnity Development Staff has interpreted the Code to have a maximum
allowance of 1,008 sq. ft. detached accessory building area with a conditional use permit.
Requests for larger accessory buildings have required a variance.

4.8 Mr. Dahmann's single-family residential lot is 128 feet wide by 298 feet deep and
includes 38,244 square feet of area (three times the size of a normal Roseville residential
lot). This portion of Shryer Avenue has a number of large, non-typical residential lots
similar to the lots along the south side of Parker Avenue directly adjacent (north).

PF3397 RPCA 060502 Page 2 of7
