<br />1 Extract of Draft Minutes, Plannin2 Commission Meetin2, June 5, 2002: <br />2 <br />3 e. Plannin2 File 3400: Request by Robert Wilson for a variance to <br />4 Section 1004.04D5 (Minimum Yard Requirements - Front Yard Setback) to <br />5 allow the replacement of an existing carport and deck with an attached <br />6 garage with living area above for property at 3107 West Owasso Boulevard. <br />7 <br />8 Chairman Duncan opened the hearing and requested City Planner Thomas <br />9 Paschke provide a summary of the project report dated June 5, 2002. <br />10 <br />11 Robert Wilson has submitted an application for a 13 foot variance to Section <br />12 1004.02D5 (Yard Requirements - Front yard Setback) to allow the replacement <br />13 of an existing carport with an attached two stall garage and living space ( above) <br />14 and a variance to Section 602.02 (Parking on Boulevard Prohibited) at 3107 West <br />15 Owasso Boulevard. <br />16 <br />17 Robert Wilson currently has a carport that lies approximately 23 feet from the <br />18 front property line. This location (non-conforming to Code) is not uncommon <br />19 for the homes and detached accessory buildings that lie along this stretch of <br />20 Owasso Boulevard. <br />21 <br />22 In April, 2002, Mr. Wilson applied for a building permit to replace their carport <br />23 with a two stall ground level attached garage and a second story living space that <br />24 would lie 17 feet from the front property line or a 13 foot encroachment into the <br />25 required front yard setback. <br />26 <br />27 Thomas Paschke provided letters and comments to the Chair for the record. He <br />28 recommended the 13-foot variance from Section 602. <br />29 <br />30 Chair Duncan read the Joseph Osterbauer, 3117 W. Owasso, opposition letter and <br />31 J.R. Tate, 3125 W. Owasso, letter. <br />32 <br />33 Member Cunningham asked for clarification of the right-of-way and the size of <br />34 the garage. <br />35 <br />36 Bob Matson, Matson Contracting, representing the owner, clarified that the <br />37 footprint would be very similar to the existing carport. He noted that Mr. Wilson <br />38 is also trying to reduce the driveway slope. <br />39 <br />40 Deb Bloom, Assistant Public Works Director, noted the steep slope, and this is a <br />41 concern and can be corrected. Her only concern was obstruction of the pathway <br />42 and roadway and those have been resolved. <br />43 <br />44 Member Cunningham asked if the house roofline would change? (No). <br />45 <br />46 Chair Duncan closed the hearing since there were no further comments. <br />47 <br />48 Member Mulder stated the challenge is the setback; the issue is that more space <br />49 which could be added on the rear (west) side of the house rather than east side. <br />50 <br />51 Thomas Paschke explained that the living area sits further back from the front <br />
