<br />WHEREAS, Mr. Paal desires to construct a3 foot attached garage addition that would <br />encroach 6 inched into the required 5 foot side yard setback; and <br /> <br />WHEREAS, the Roseville Planning Commission held the public hearing regarding the <br />Paal variance request (Section 1004.02D5) on August 6, 2003, and recommended (5-0) approval <br />of the request based on findings outlined in Section 5 and conditions of Section 6 of the project <br />report dated August 6, 2003. <br /> <br />NOW THEREFORE BE IT RESOLVED, by the Roseville City Council, to grant James <br />Paal a 6 inch V ARIANCE to Section 1004.02D5 (Dwelling Dimensions - Side Yard Setback) of <br />the Roseville City Code allowing the construction of an attached garage to a point 24 feet from <br />the front yard property line for property located at 1413 Millwood Avenue, subject to the <br />following conditions: <br /> <br />1. The front yard setback being established at 24 feet, which distance allows a 20 <br />foot addition on to the south side of the principal structure. <br /> <br />2. The side yard setback being established at 4 feet 6 inches, which distance allows <br />for a 3 foot addition on to the east side of the principal structure. <br /> <br />3. Gutters and downspouts must be installed along the eves of the garage and living <br />area addition to properly direct runoff into the front and rear yard. <br /> <br />4. Windows being installed on the west and east sides of the building wall of the <br />new garage, per the submitted elevation drawing. <br /> <br />5. The review and approval of a building permit must be consistent with the <br />approved plans and variances. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Council <br />Member Maschka and upon vote being taken thereon, the following voted in favor: Klausing, <br />Schroeder, Kough, Maschka, and Kysylyczyn; <br />and the following voted against: None <br /> <br />WHEREUPON said resolution was declared duly passed and adopted. <br /> <br />2 <br />
