<br />REQUEST FOR CITY COUNCIL ACTION <br /> <br />DATE:09/15/03 <br />ITEM NO: XI. E. <br /> <br />Department Approval: <br />TP/DPW <br /> <br />Item Description: <br /> <br />Manager Approved: <br />~~ <br /> <br />Request by David Torgersen for a Minor Subdivision (Correction) to <br />eliminate overlapping descriptions for property located 1965-1981 <br />County Road C2 (PF3511). <br /> <br />Agenda Section <br />CONSENT <br /> <br />1.0 REQUESTED ACTION: <br /> <br />1.1 David Torgersen, surveyor (on behalf of Scott W. Roberts), has requested City Council <br />approval of a "Correction" between two legal conforming lots in Roseville (property in <br />question located at 1965 - 1981 Cleveland Avenue). <br /> <br />1.2 Section 11 04.04D specifies the procedures for consideration and approval of a <br />"Correction." Specifically, this section of the City Code states: "Correction": when a <br />surveyor description of a parcel or lot has been found to be inadequate to describe the <br />actual boundaries, approval of a corrective subdivision may be requested. This type of <br />subdivision creates no new lots or streets. The proposed corrective subdivision, in sketch <br />plan form, along with a letter signed by all affected owners agreeing to the new <br />subdivision, shall be submitted to the City Council for approval. No hearing or Planning <br />Commission review is necessary unless the proposal is referred to the Commission by the <br />Community Development Director for clarification. Within 30 days after approval by the <br />City Council, the applicant shall supply the final survey to the Community Development <br />Director and City Manager for review and approval. After completion of the review and <br />approval by the Community Development Director and City Manager, the survey shall be <br />recorded by the applicant with the Ramsey County Recorder within 60 days. Failure to <br />record the subdivision within the 60 days shall nullify the approval of the subdivision." <br /> <br />2.0 REVIEW of REQUEST: <br /> <br />2.1 On May 16, 1986, David Torgersen prepared the Langdon Lake Industrial Park <br />subdivision, for which he received approval and recorded said plat. <br /> <br />2.2 Since that date, Mr. Torgersen has become aware of errors within the legal description of <br />Langdon Lake Industrial Park and wishes to correct the legal description error. <br /> <br />3.0 STAFF RECOMMENDATION: <br /> <br />3.1 The Community Development Staff recommends approval of the request by David <br />Torgersen to correct errors in the previously recorded subdivision of Lots 2 and 3, Block <br />1, Langdon Lake Industrial Park, subject to: <br /> <br />PF3511-RCA 091503 Page 1 <br />
