<br />WHEREAS, Mr. Anderson has tried a number of reasonable and costly methods for <br />deterring or distracting the deer that enter and damage his flowers, trees, and vegetables; and <br /> <br />WHEREAS, The Roseville Planning Commission held the public hearing regarding the <br />Anderson request on September 3,2003, recommending (7-0) approval of the variance request <br />based on the findings of Section 5 and conditions of Section 6 of the project report dated <br />September 3,2003; <br /> <br />NOW THEREFORE BE IT RESOLVED, by the Roseville City Council, to APPROVE <br />the request by Charles Anderson for a VARIANCE to Section lOl2.02B & C (Fence Height) of <br />the Roseville City Code, subject to the following conditions; <br /> <br />1. The extended fence be a maximum of 828 feet in length and 9 feet in height to <br />exclude deer and protect landscaping as illustrated in site plans. <br /> <br />2. The review and approval of a building permit be consistent with the approved <br />plans and variance. <br /> <br />3. The Fencing material used for the proposed fencing must be installed within the <br />property owner's parcel in accordance to Section lOl2.02Cl (Location). <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Council <br />Member Kough and upon vote being taken thereon, the following voted in favor: Maschka, <br />Klausing, Kough and Kysylyczyn <br />and the following voted against: None <br /> <br />WHEREUPON said resolution was declared duly passed and adopted. <br /> <br />2 <br />
