<br />become increasingly severe. One matm:e apple tree and several Crab Apple trees <br />( attached photo) have been killed or suffer extensive deer damage. Among other things <br />destroyed on the property include (4) North Star cherry trees, (2) fruiting plums, and <br />many (at least 25) roses. That being said, Mr. Anderson has only one reasonable and <br />practical option, extend the existing fence to 9 feet in height, two feet six inches above <br />the six foot six inch maximum. The Community Development Staff has determined <br />that the plight of the landowne r is due to circumstances unique to the property <br />not created by the landowner. <br />C. The variance, ifgranted, will not alter the essential character oIthe locality: <br />The Community Development Staff has determined that this variance, if <br />granted, will not alter the essential character of the locality, nor adversely <br />affect the public health, safety, or general welfare, of the city or adjacent <br />properties. <br /> <br />6.0 STAFF RECOMMENDATION: <br /> <br />6.1 Based on the information provided and the [mdings in Section 5 and 6 of this project report, <br />staffrecornmends approval ofa 2 foot 6 inch fence height VARIANCE to Section 1012.02B3 <br />ofthe Roseville City Code to allow construction of a 9 foot high fence at 303 S. Owasso <br />Boulevard, subject to the following conditions: <br /> <br />A. The extended fence be a maximum of rougWy 828 feet in length and 9 feet in height to <br />exclude deer and protect landscaping as illustrated in site plans. <br /> <br />B. The review and approval of a building permit consistent with the approved plans and <br />vanance. <br /> <br />C.
