<br />REQUEST FOR COUNCIL ACTION <br />DATE: 07/11/05 <br />ITEM NO: <br /> <br />Department Approval: <br /> <br />Manager Approved: <br /> <br />Agenda Section: <br /> <br />DPW/TP Consent <br /> <br />Item Description: Request for approval of Corrective Subdivision (Lot line Correction) for <br />United Properties - Applewood Townhomes (PF3654) <br /> <br />1.0 BACKGROUND: <br /> <br />1.1 United Properties seeks Council approval of a one foot correction on the location of a common <br />property line between two town home lots (lots 9 and 10) within Applewood Pointe of Arona <br />Third Addition. Lot 9 should have been 24 feet in width, not 25 feet as shown on the plat. No new <br />lots or structures will be created and no variances are needed. <br /> <br />1.2 The City Code Section 11 04.04D allows for property owner to correct mistakes in lot line location <br />and dimensions as seen below: <br />Corrections: When a surveyor description of a parcel or lot has been found to be inadequate to <br />describe the actual boundaries, approval of a corrective subdivision may be requested. This type <br />of subdivision creates no new lots or streets. The proposed corrective subdivision, in sketch plan <br />form, along with a letter signed by all affected owners agreeing to the new subdivision, shall be <br />submitted to the City Council for approval. No hearing or Planning Commission review is <br />necessary unless the proposal is referred to the Commission by the Community Development <br />Director for clarification. The proposed parcels shall not cause any portion of the existing lots, <br />parcels, or existing buildings to be in violation of this regulation or the zoning code. A certificate <br />of survey illustrating the corrected boundaries shall be required on all parcels. Within thirty (30) <br />days after approval by the City Council, the applicant shall supply the final survey to the <br />Community Development Director and City Manager for review and approval. After completion <br />of the review and approval by the Community Development Director and City Manager, the <br />survey shall be recorded by the applicant with the Ramsey County Recorder within sixty (60) <br />days. Failure to record the subdivision within sixty (60) days shall nullifY the approval of the <br />subdivision. <br /> <br />1.3 STAFF RECOMMENDATION: <br />The proposal meets the criteria for a corrective subdivision and therefore the Community <br />Development Staff recommends approval. <br /> <br />2.0 SUGGESTED COUNCIL ACTIONS: <br />By motion, approve the United Properties request to realign the common lot line between lots 9 <br />and 10 of App1ewood Pointe of Arona Third Addition as illustrated on the survey dated June 16, <br />2005.
