<br />REQUEST FOR COUNCIL ACTION <br /> <br />DATE: 01/26/04 <br />ITEM NO: 7 (1 of 2) <br /> <br />Department Approval: <br />TP jDPW <br /> <br />Item Description: <br /> <br />..~ ,~ity MJnag~h Appr~~al: Agenda Section: <br />I ~ U: Clt 'LXJ::~ &:,;) CUP AND PUBLIC HEARING <br />Request by Speedway SuperAmerica for a CONDITIONAL USE <br />PERMIT in accordance with Section 1005.04C17 and 10B.01D <br />(Conditional Use Permits) of the Roseville City Code at 2172 <br />Lexington Avenue (PF 3524). <br /> <br />1.0 REQUESTED ACTION: <br /> <br />1.1 SuperAmerica, 2172 Lexington Avenue, has requested a CONDITIONAL USE PERMIT in <br />accordance with Section 1005.05C19 and 1013.01 (Conditional Use Permits) of the Roseville <br />City Code to allow off-sale liquor sales in a 2,200 sq. ft. portion of the convenience store with a <br />separate entry. <br /> <br />1.2 Super America has also requested a LIQUOR LICENSE for which a public hearing will be held <br />on January 26, 2004. This separate (from the CUP) liquor license approval is decided upon by the <br />City Council. Super America will need to meet the requirements of Section 302.13 Off Sale <br />License Regulations of the Roseville City Code. <br /> <br />PROJECT REVIEW HISTORY <br />. Application submitted & determined complete on September 2,2003. <br />. 60-day review deadline on November 2,2003. <br />. Planning Commission: Continued Action - October 1, 2003. <br />. Review extension to December 31,2003 by City Council- October 13,2003 <br />. Applicant request for review extension on November 10 for additional 60 days (December 31, <br />2003 to February 29, 2004. <br />. Staff Recommendation: Approval w/conditions - January 7, 2004 <br />. Plan.Comrn.: Hearing Recommendation - Denial with findings (6-0) January 7,2004 <br />. City Council decision anticipated: January 26, 2004 <br /> <br />2.0 SUMMARY OF RECOMMENDATIONS: <br /> <br />2.1 The Community Development Staff recommended approval ofa CONDITIONAL USE <br />PERMIT in accordance with Sections 1005.04C17 and 1013.01D (Conditional Use Permits) of <br />the Roseville City Code for SuperAmerica to allow off-sale liquor sales in a 2,200 sq. ft. <br />separated portion of the convenience store, with a separate east side entry at 2172 Lexington <br />Avenue, subject to conditions. <br /> <br />2.2 The Planning Commission, on January 26, 2004 and after holding a public hearing, recommended <br />denial of the CONDITIONAL USE PERMIT, 6-0 with findings (attached). <br /> <br />3.0 SUGGESTED ACTION: <br /> <br />3.1 By RESOLUTION AND WITH FINDINGS, approve, modify, or deny the request.
