EXTRACT OF MINUTES OF MEETING OF THE CITY COUNCIL OF THE CITY OF ROSEVILLE Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Roseville, County of Ramsey, Minnesota, was held on the 26th day of January, 2004, at 6:30 p.m. The following members were present: Klausing, Kough, Maschka, and Schroeder and the following were absent: None introduced the following resolution and moved its adoption: Council Member RESOLUTION NO. A RESOLUTION APPROVING A CONDITIONAL USE PERMIT IN ACCORDANCE WITH SECTION 1005.04C17 AND 10B.01D OF THE ROSEVILLE CITY CODE FOR SPEEDWAY SUPERAMERICA, 2172 LEXINGTON AVENUE (PF3524). WHEREAS, Speedway SuperAmerica has requested a Conditional Use Permit in accordance with Section 1005.04C17 and 1013.01 of the Roseville City Code to allow a 2,200 sq. ft. portion of the existing convenience store to be converted into an off-sale liquor store; and WHEREAS, the property in question is the Speedway SuperAmerica site at 2172 Lexington Avenue, legally described as: Requires Correct Legal Description PIN: 11-29-23-33-0065 WHEREAS; the proposal by Speedway SuperAmerica seeks to convert 2,200 sq. ft. of the existing general merchandising sales area into a separate off-sale liquor store with a separate exterior access; and WHEREAS, Section 1013 establishes the criteria for reviewing conditional use permits, which is as follows: a. Impact on traffic b. Impacts on parks, streets and other public facilities c. Compatibility of the site plan, internal circulation, landscaping and structure with contiguous properties d. Impact of the use on market value of contiguous properties e. Impact on the general public health, safety and welfare f. Compatibility with the City's Comprehensive Plan WHEREAS, City staff has reviewed the proposed additional use to the existing Speedway SuperAmerica facility and concluded the proposal meets these criteria.
