Impact on the general public health, safety and welfare: <br /> <br />Use of the SuperAmerica site as an off-sale liquor store will not have an impact <br />on the general health, safety, and welfare of neighboring residents and land <br />owners. The Community Development Department has concluded that the <br />impression that this liquor store will create added crime, public drunkenness, and <br />pedestrian conflict with impaired drivers cannot be reasonably validated. There <br />are no reports or existing crime statistics from this site or other off-sale liquor <br />sites. <br /> <br />Based on this, staff concludes that this added new use and 100 new trips will not <br />impact the general public health, safety and welfare of the surrounding <br />neighborhood, nor the City of Roseville. <br /> <br />f. Compatibility with the City's Comprehensive Plan: <br /> <br />Use of the SuperAmerica site as an off-sale liquor store is compatible with the <br />Roseville Comprehensive Plan. Specifically, the Roseville Comprehensive Land <br />Use Plan identifies this site as "Business" use which an off-sale liquor store is an <br />appropriate use. Further, the Comprehensive Plan does not specifically limit this <br />site to limited types of business, commercial, or retail uses. <br /> <br />NOW THEREFORE BE IT RESOLVED, by the Roseville City Council, to APPROVE the <br />request by Speedway SuperAmerica for a CONDITIONAL USE PERMIT in accordance with <br />Section 1013.01 of the Roseville City Code, subject to the following conditions; <br /> <br />1. The off-sale liquor portion of the convenience store being limited to a size of <br />2,200 square feet. <br /> <br />2. The separate liquor store entrance must be from the east side of the building. <br /> <br />3. The parking and island area located on the south side of the structure must be <br />modified so that all stalls face north (as per Consultant's report of December 18, <br />2003). <br /> <br />4. The review and approval of a building permit for renovations must be consistent <br />with the approved conditional use permit plans. <br /> <br />5. Because this store is adjacent to existing residential development, hours of <br />operation and delivery being limited to standard hours of "stand alone" liquor <br />store operations, with the liquor store closing by 8 pm. Monday through <br />Thursday, and by 10 pm Friday and Saturday. <br /> <br />4 <br />
