<br />4.0 REVIEW of REQUEST: <br /> <br />4.1 SuperAmerica has submitted a proposal to create a 2,200 sq. ft. off-sale liquor store within a <br />portion of the existing convenience store as a separate store with a separate east side entrance. <br /> <br />4.2 The property located at 2172 Lexington Avenue (Speedway SuperAmerica) was redeveloped <br />as a Super America store in 1985 and lies on a 73,345 square foot parcel. This site is located <br />adjacent to single family residential (east) and multi- family housing (Lexington Court Apartments <br />- 52 units; to the south is the Jordan Stop gas station; to the west is TCF Bank; and to the <br />southwest is Lexington Park. <br /> <br />5.0 STAFF COMMENTS/FINDINGS: <br /> <br />a. Section 302.13 (Off-Sale License Regulations) stipulates that the requirements by which off- <br />sale liquor may be sold. Specifically sub-section C (Size of Premises) stipulates that licensed <br />premises shall have at least one thousand six hundred (1,600) square feet of sales floor space <br />including sales coolers and excluding walk-in storage coolers. <br /> <br />b. Section 1005.04C17 (Uses Allowed by Conditional Use Permit) reads: Off-sale liquor stores <br />not located in "shopping centers" as defined at Section 1002.02 of this title. (Ord.958, 7-23- <br />1984) <br /> <br />c. The City Planner has reviewed the proposal and determined that the City Code does allow for <br />off-sale liquor sales in a 2,200 sq. ft. portion ofthe Speedway SuperAmerica convenience store <br />with a separate liquor store and entry (similar to a previous separation at Love from Minnesota, <br />2465 Fairview). <br /> <br />d. Section 1013.0ID (Criteria For Issuance of Conditional Use Permit) states, when reviewing an <br />application for a Conditional Use Permit, the Planning Commission and City Council shall <br />consider the following criteria: <br /> <br />a. Impact on traffic: <br /> <br />The use of SuperAmerica as an off-sale liquor store will not significantly impact traffic. <br />Specifically, the traffic study completed by SEH Consultants indicates that overall traffic <br />on the SuperAmerica site will increase by approximately 3.5% or an increase of <br />approximately 100 vehicle trips per day on a site that currently produces an estimated <br />3,400 vehicle trips per day (see Attachment A and next page). <br /> <br />PF3524 - RPCA 010704 - Page 2 of 5 <br />
