<br />4.0 REVIEW of REQUEST: <br /> <br />4.1 Kara Rose has submitted a proposal to construct a deck and enclosed porch on to the west <br />side of the home, which addition would encroach 11 feet into the required corner setback <br />adjacent to a public street. The City Code (Section 1004.02D4) regulates where <br />structures can be placed on a corner lots with setback requirements. In the case of the <br />Rose parcel, there is a 30 foot minimum setback (side yard adjacent a public street) <br />applied to the west property line (Aglen Street). <br /> <br />4.2 The Rose home was constructed in 1956 and lies on a parcel that averages 93.5 feet by <br />146.7 feet or 13,717 sq. ft. in size. The parcel has an impervious coverage allowance of <br />4,115 sq. ft. of which 2,608 sq. ft. is being utilized (house foundation & attached garage <br />size of2,128 sq. ft and existing driveway of 480 sq. ft). <br /> <br />4.3 Variance Conditions Proposed: <br /> <br />SECTION 1004.02D4 <br />Structure Adjacent <br />Public Street <br />30 feet <br /> <br />Existin Condition <br /> <br />Pro osed Condition Variance Re uested <br /> <br />33 feet <br /> <br />19 feet - a licant 11 feet - a licant <br /> <br />5.0 STAFF COMMENTS/FINDINGS: <br /> <br />5.1 Section 1 004.02D4 reads: "a side yard adjacent to a street on a corner lot shall not be <br />less than 30 feet". The existing Rose principal structure was constructed in 1956 <br />before the adoption of the City Code. The existing home lies 30 feet from the <br />property line adjacent to Aglen Street and the proposed condition would place the <br />deck and porch footings 19 feet from the property line adjacent to Aglen Street. <br />The Rose parcel requires setbacks of 30 feet from the north, south, and west <br />property line, and 5 feet from the east property line. <br /> <br />5.2 The proposal seeks to construct a 14 foot by 14 foot porch and a 14 foot by 10 foot deck <br />on to the west side of the home. The west side has been selected by the applicant <br />because of the close proximity to the kitchen, living and dining rooms, and the ability to <br />construct without eliminating existing windows. <br /> <br />5.3 The Rose parcel is a corner lot and as such the parcel has a required 30 foot setback from <br />the front yard (north) the rear yard (south) and the yard adjacent to a public street (west), <br />and a 5 foot setback for the side yard (east). <br /> <br />5.4 In review of the applicant's proposal, staff has detern1ined that the proposed location of <br />the deck and porch is the most practical and a reasonable solution given the configuration <br />of the home and the options available. A deck or porch on the rear of the home would <br />also require a variance (18 feet) and location the deck/porch in the front or side yard is <br />not a practical or reasonable solution and would require a variance to allow in a front <br />yard. <br /> <br />PF3536 - ReA 022304 - Page 2 of 5 <br />
